- EnglishIn the case of the national sovereignty or the territorial integrity being seen as in grave and imminent danger by external armed aggressions, the Executive Power, without prejudice to the inherent abilities of his office, may request from the National Congress the declaration of State of Defense. In this state the following may not be suspended:
1. The right to life, following the provisions of Article 37.
2. The right to personal integrity, following the provisions of Article 42.
3. Liberty of conscience and religions, following the provisions of Article 45.
4. The protection of the family, following the provisions of Article 55.
5. The right to one’s name, following the provisions of Article 55, number 7.
6. The rights of the child, following the provisions of Article 56.
7. The right to nationality, following the provisions of Article 18.
8. The rights of citizenship, following the provisions of Article 22.
9. The prohibition of slavery and servitude, following the provisions of Article 41.
10. The principle of legality and of non-retroactivity, following that established in Article 40, numbers 13 and 15.
11. The right to the recognition of juridical personality, following the provisions of Articles 43 and 55, number 7.
12. The judicial, process, and institutional guarantees indispensable for the protection of those rights, following the provisions of Article 69, 71, and 72. (Art. 263) - SpanishEn caso de que la soberanía nacional o la integridad territorial se vean en peligro grave e inminente por agresiones armadas externas, el Poder Ejecutivo, sin perjuicio de las facultades inherentes a su cargo, podrá solicitar al Congreso Nacional la declaratoria del Estado de Defensa. En este estado no podrán suspenderse:
1) El derecho a la vida, según las disposiciones del artículo 37;
2) El derecho a la integridad personal, según las disposiciones del artículo 42;

8) Los derechos de ciudadanía, según las disposiciones del artículo 22;
9) La prohibición de esclavitud y servidumbre, según las disposiciones del artículo 41;
10) El principio de legalidad y de irretroactividad, según se establece en el artículo 40, numerales 13) y 15);
11) El derecho al reconocimiento de la personalidad jurídica, según las disposiciones de los artículos 43 y 55, numeral 7);
12) Las garantías judiciales, procesales e institucionales indispensables para la protección de estos derechos, según las disposiciones de los artículos 69, 71 y 72. (Art. 263)

- EnglishThe territory in which the guarantees mentioned in the preceding article are suspended shall be governed during the suspension, by the state of siege law, but neither that law nor any other may provide for the suspension of any guarantees other than those already mentioned.
Likewise, during the suspension no new offenses may be established or penalties imposed other than those established by laws in force at the time the suspension was decreed. - EnglishThe National Assembly and all bodies with legal and regulatory authority shall be obligated to adjust, formally and materially, the laws and other legal standards related to the rights provided for in the Constitution and international treaties and those that are needed to guarantee the dignity of human beings or communities, peoples and nations. In no case shall amending the Constitution, laws, other legal and regulatory frameworks or actions by the government endanger the rights recognized by the Constitution. (Art. 84)

The President of the Republic, in the Council of Ministers[,] can decree, for the totality or part of the national territory and for [a] determined and extendable time [tiempo], the suspension of rights and guarantees when the security of the nation, the economic conditions or some national catastrophe demands it. The Law of Emergency will regulate its modalities. (Art. 185)

El Presidente de la República, en Consejo de Ministros, podrá decretar, para la totalidad o parte del territorio nacional y por tiempo determinado y prorrogable, la suspensión de Derechos y Garantías, cuando así lo demande la seguridad de la nación, las condiciones económicas o en caso de catástrofe nacional.
La Ley de Emergencia regulará sus modalidades. (Art. 185)

- EnglishI. The rights recognized in this Constitution are inviolable, universal, interdependent, indivisible and progressive. The State has the duty to promote, protect and respect them.
II. The rights declared in this Constitution shall not be understood to deny other rights that are not enumerated.
III. The classification of the rights established in this Constitution does not determine any hierarchy or superiority of some rights over others.
IV. International treaties and conventions ratified by the Pluri-National Legislative Assembly (Asamblea Legislativa), which recognize human rights and prohibit their limitation in States of Emergency, prevail over internal law. The rights and duties consecrated in this Constitution shall be interpreted in accordance with the International Human Rights Treaties ratified by Bolivia. (Art. 13) - SpanishI. Los derechos reconocidos por esta Constitución son inviolables, universales, interdependientes, indivisibles y progresivos. El Estado tiene el deber de promoverlos, protegerlos y respetarlos.
II. Los derechos que proclama esta Constitución no serán entendidos como negación de otros derechos no enunciados.
III. La clasificación de los derechos establecida en esta Constitución no determina jerarquía alguna ni superioridad de unos derechos sobre otros.
IV. Los tratados y convenios internacionales ratificados por la Asamblea Legislativa Plurinacional, que reconocen los derechos humanos y que prohíben su limitación en los Estados de Excepción prevalecen en el orden interno. Los derechos y deberes consagrados en esta Constitución se interpretarán de conformidad con los Tratados internacionales de derechos humanos ratificados por Bolivia. (Art. 13)
