Such suspension can affect all or part of the territory of the Republic, and will be conducted by means of a decree of the Legislative Organ or [of] the Executive Organ, as the case may be.

II. Those persons who violate the rights established in this Constitution shall be subject to criminal process for violation of rights.

- EnglishAll persons have the right to an action of amparo in order to demand before the courts, for themselves or by those who act in their name, immediate protection of their fundamental rights, not protected by habeas corpus, when they are violated or threatened by the action or omission of any public authority or of individuals, in order put into effect the fulfillment of a law or administrative act and in order to guarantee collective and diffuse rights and interests. In accordance with the law, the proceeding is preferential, summary, oral, public, free, and not subject to formalities.

The acts adopted during the States of Exception that violate protected rights that unreasonably cause suspended rights are subject to actions of amparo. (Art. 72) - SpanishToda persona tiene derecho a una acción de amparo para reclamar ante los tribunales, por sí o por quien actúe en su nombre, la protección inmediata de sus derechos fundamentales, no protegidos por el hábeas corpus, cuando resulten vulnerados o amenazados por la acción o la omisión de toda autoridad pública o de particulares, para hacer efectivo el cumplimiento de una ley o acto administrativo, para garantizar los derechos e intereses colectivos y difusos. - EnglishIn the cases of invasion, grave disturbance of the public peace, or any other which places society in grave danger or conflict, only the President of the United Mexican States, with the approval of the Congress of the Union or of the Permanent Commission when it is not meeting, may restrict or suspend in all the country or in a specific place the exercise of the rights and guarantees which could be an obstacle to [a] rapid and effective [fácilmente] response [frente] to the situation; but he must do so for a limited time, by means of general preventions without the restriction or the suspension being limited to a specified person. If the restriction or suspension should take place while the Congress is meeting, it will concede the authorizations that it deems necessary for the Executive to respond to the situation; but if it is verified in a time of recess, the Congress will be convoked immediately to agree to them.
In the decrees which are enacted, [the following] may not be restricted or suspended[:] the exercise of the rights to non-discrimination, to recognition of juridical personality, to life, to personal integrity, to the protection of the family, to [one's] name, to nationality; the rights of the child; the political rights; the freedoms of thought, conscience and of professing any religious belief; the principle of legality and retroactivity; the prohibition of the penalty of death; the prohibition of slavery and servitude; the prohibition of forced disappearance and torture; neither the judicial guarantees indispensible for the protection of these rights.
The restriction or suspension of the exercise of the rights and guarantees must be substantiated and motivated in the terms established by this Constitution and be proportional to the danger that it confronts, observing at each moment the principles of legality, rationality, proclamation, publicity, and non-discrimination.
When the restriction or suspension of the exercise of the rights and guarantees is brought to an end, as well as for the compliance with the time [plazo] or reason [porque] as the Congress decrees [it], all the legal and administrative measures adopted during its effectiveness will be of no effect in immediate form. The Executive may not make observations to the decrees by means of which the Congress revokes the restriction or suspension.
The decrees enacted by the Executive during the restriction or suspension, must be reviewed [revisdos], of office and immediately[,] by the Supreme Court of Justice of the Nation, which must decide on them with the greatest promptness concerning their constitutionality and validity. En los decretos que se expidan, no podrá restringirse ni suspenderse el ejercicio de los derechos a la no discriminación, al reconocimiento de la personalidad jurídica, a la vida, a la integridad personal, a la protección a la familia, al nombre, a la nacionalidad; los derechos de la niñez; los derechos políticos; las libertades de pensamiento, conciencia y de profesar creencia religiosa alguna; el principio de legalidad y retroactividad; la prohibición de la pena de muerte; la prohibición de la esclavitud y la servidumbre; la prohibición de la desaparición forzada y la tortura; ni las garantías judiciales indispensables para la protección de tales derechos.
La restricción o suspensión del ejercicio de los derechos y garantías debe estar fundada y motivada en los términos establecidos por esta Constitución y ser proporcional al peligro a que se hace frente, observando en todo momento los principios de legalidad, racionalidad, proclamación, publicidad y no discriminación.
Cuando se ponga fin a la restricción o suspensión del ejercicio de los derechos y garantías, bien sea por cumplirse el plazo o porque así lo decrete el Congreso, todas las medidas legales y administrativas adoptadas durante su vigencia quedarán sin efecto de forma inmediata. El Ejecutivo no podrá hacer observaciones al decreto mediante el cual el Congreso revoque la restricción o suspensión.
Los decretos expedidos por el Ejecutivo durante la restricción o suspensión, serán revisados de oficio e inmediatamente por la Suprema Corte de Justicia de la Nación, la que deberá pronunciarse con la mayor prontitud sobre su constitucionalidad y validez. (Art. 29)

- English(1) The rights recognized in sections 17, 18, subsections 2 and 3, sections 19, sections 21, 28, subsection 2, and section 37, subsection 2, may be suspended when a state of emergency or siege (martial law) is declared under the terms provided in the Constitution. Subsection 3 of section 17 is excepted from the foregoing provisions in the event of the declaration of a state of emergency.
(2) An organic act may determine the manner and the circumstances in which, on an individual basis and with the necessary participation of the courts and proper parliamentary control, the rights recognized in section 17, subsection 2, and 18, subsections 2 and 3, may be suspended for specific persons in connection with investigations of the activities of armed bands or terrorist groups.
Unwarranted or abusive use of the powers recognized in the foregoing organic act shall give rise to criminal liability as a violation of the rights and freedoms recognized by the laws. 20, subsection 1, paragraphs a) and d), and subsection 5. (Sec. 55) - Spanish1. Los derechos reconocidos en los artículos 17, 18, apartados 2 y 3, artículos 19, 20, apartados 1 a) y d), y 5, artículos 21, 28, apartado 2, y artículo 37, apartado 2, podrán ser suspendidos cuando se acuerde la declaración del estado de excepción o de sitio en los términos previstos en la Constitución. Se exceptúa de lo establecido anteriormente el apartado 3 del artículo 17 para el supuesto de declaración de estado de excepción.
2. Una ley orgánica podrá determinar la forma y los casos en los que, de forma individual y con la necesaria intervención judicial y el adecuado control parlamentario, los derechos reconocidos en los artículos 17, apartado 2, y 18, apartados 2 y 3, pueden ser suspendidos para personas determinadas, en relación con las investigaciones correspondientes a la actuación de bandas armadas o elementos terroristas.
La utilización injustificada o abusiva de las facultades reconocidas en dicha ley orgánica producirá responsabilidad penal, como violación de los derechos y libertades reconocidos por las leyes. (Art. 55)
