- EnglishAll citizens are guaranteed the right to establish, organize and develop political parties and movements, and the freedom to affiliate with them or to withdraw.
In no case is it permitted to citizens to belong simultaneously to more than one party or political movements with juridical personality.
The Political Parties and Movements shall be democratically organized and shall hold with high principles of transparency, objectivity, morality, gender equity, and the duty to present and disseminate their political programs.
To make their decisions or the selection of their own candidates or [candidates] by coalition, [they] may hold popular or internal or interparty consultations which [do] or do not coincide with the elections to Public Corporations, in accordance with that provided in their Statutes and in the law.
In the case of the public consultations, the norms concerning campaign financing and publicity and access to the media of communication of the State, that govern for the ordinary elections, will be applied. Anyone who participates in consultations of a political party or movement or in interparty consultations may not enroll for another in the same electoral process. The result of the consultations will be obligatory.
The directors of the Political Parties and Movements should encourage internal processes of democratization and the strengthening of the regime of [party] blocs [bancadas].
The Political Parties and Movements are responsible for any violation or contravention of the norms that serve their organization, operation or financing, as well as when endorsing candidates elected to offices or Public Corporations of popular election, who have been or are convicted during the exercise of the office to which [they were] endorsed, by way of executory sentence in Colombia or abroad for crimes related to communication with illegal armed groups and drugtrafficking activities or of crimes against the mechanisms of democratic participation or [crimes] against humanity.
The Political Parties or Movements will also be responsible for endorsing candidates not elected to offices or Public Corporations of popular election, if they have been or are convicted during the period of public office to which they are candidates, by way of executory sentence in Colombia or abroad for crimes related to communication with illegal armed groups and drug-trafficking activities, committed prior to the issuance of the corresponding endorsement.

En ningún caso se permitirá a los ciudadanos pertenecer simultáneamente a más de un partido o movimiento político con personería jurídica.
Los Partidos y Movimientos Políticos se organizarán democráticamente y tendrán como principios rectores la transparencia, objetividad, moralidad, la equidad de género, y el deber de presentar y divulgar sus programas políticos.
Para la toma de sus decisiones o la escogencia de sus candidatos propios o por coalición, podrán celebrar consultas populares o internas o interpartidistas que coincidan o no con las elecciones a Corporaciones Públicas, de acuerdo con lo previsto en sus Estatutos y en la ley.
En el caso de las consultas populares se aplicarán las normas sobre financiación y publicidad de campañas y acceso a los medios de comunicación del Estado, que rigen para las elecciones ordinarias. Quien participe en las consultas de un partido o movimiento político o en consultas interpartidistas, no podrá inscribirse por otro en el mismo proceso electoral. El resultado de las consultas será obligatorio.
Los directivos de los Partidos y Movimientos Políticos deberán propiciar procesos de democratización interna y el fortalecimiento del régimen de bancadas.
Los Partidos y Movimientos Políticos deberán responder por toda violación o contravención a las normas que rigen su organización, funcionamiento o financiación, así como también por avalar candidatos elegidos en cargos o Corporaciones Públicas de elección popular, quienes hayan sido o fueren condenados durante el ejercicio del cargo al cual se avaló mediante sentencia ejecutoriada en Colombia o en el exterior por delitos relacionados con la vinculación a grupos armados ilegales y actividades del narcotráfico o de delitos contra los mecanismos de participación democrática o de lesa humanidad.
Los partidos o movimientos políticos también responderán por avalar a candidatos no elegidos para cargos o Corporaciones Públicas de Elección Popular, si estos hubieran sido o fueren condenados durante el período del cargo público al cual se candidatizó, mediante sentencia ejecutoriada en Colombia o en el exterior por delitos relacionados con la vinculación a grupos armados ilegales y actividades del narcotráfico, cometidos con anterioridad a la expedición del aval correspondiente.

- EnglishThe organization of parties, groups and political movements is free and subject to the principles established in this Constitution. Their conformation and functioning should support themselves in respect for internal democracy and transparency, in accordance with the law. Its essential purposes are:
1. To guarantee the participation of male and female citizens in the political processes that contribute to the strengthening of democracy.
2. To contribute in equality of conditions, to the formation and manifestation of the citizen will, respecting political pluralism through the proposal of candidate lists to offices of popular election.
3. To serve the national interest, the collective well-being and the complete development of Dominican society. (Art. 216) - SpanishLa organización de partidos, agrupaciones y movimientos políticos es libre, con sujeción a los principios establecidos en esta Constitución. Su conformación y funcionamiento deben sustentarse en el respeto a la democracia interna y a la transparencia, de conformidad con la ley. Sus fines esenciales son:
1) Garantizar la participación de ciudadanos y ciudadanas en los procesos políticos que contribuyan al fortalecimiento de la democracia;

- EnglishPolitical parties express political pluralism, contribute to the formation and manifestation of the popular will, and are fundamental instruments of political participation, without prejudice to the freedom of electoral nomination in the form prescribed by this Constitution and by law. The internal structure and the functioning of political parties shall be based on democratic principles.
The law shall regulate the registration and the continued existence of political parties but in no case may provide that the minimum number of votes required for survival is higher than five percent (5%) of the valid votes cast in elections for President, members of the National Assembly, Mayors or Precinct Representatives, whichever is the vote in which the party concerned has been most successful. (Art. 138) - SpanishLos partidos políticos expresan el pluralismo político, concurren a la formación y manifestación de la voluntad popular y son instrumentos fundamentales para la participación política, sin perjuicio de la postulación libre en la forma prevista en esta Constitución y la Ley. La Ley reglamentará el reconocimiento y subsistencia de los partidos políticos, sin que, en ningún caso, pueda establecer que el número de los votos necesarios para su subsistencia sea superior al cinco por ciento de los votos válidos emitidos en las elecciones para Presidente, Diputados, Alcaldes o Representantes de Corregimientos, según la votación más favorable al partido. Political parties cannot participate [intervenir] in other than their own activities or have any privilege or monopoly on civic participation; their records and accounts must be public; their sources of finance cannot come from monies, assets, donations, contributions or credits of foreign origin; their statutes must contemplate the norms assuring an effective internal democracy. A constitutional organic law will establish a system of primary elections that may be used by those parties for the nomination of candidates to offices of popular election, whose results will be binding on such collectivities, save the exceptions that this law establishes. Those that are not elected in the primary elections may not be candidates, in that election, to the respective office. A constitutional organic law will regulate the other matters that concern them and the sanctions that are applicable for the infringement of its provisions, among which their dissolution may be considered. The associations, movements, organizations or groups of persons engaged in or performing [realizar] activities pertaining to political parties without conforming to the aforementioned norms are unlawful and will be penalized in accordance with this constitutional organic law;
The Political Constitution guarantees political pluralism. The parties, movements or other forms of organization of which the objectives, acts or conduct do not respect the basic principles of the democratic and constitutional regime, advocate the establishment of a totalitarian system, as well as those which use violence, or advocate or incite it as a method of political action, are unconstitutional. It will correspond to the Constitutional Tribunal to declare such unconstitutionality.

Los partidos políticos no podrán intervenir en actividades ajenas a las que les son propias ni tener privilegio alguno o monopolio de la participación ciudadana; la nómina de sus militantes se registrará en el servicio electoral del Estado, el que guardará reserva de la misma, la cual será accesible a los militantes del respectivo partido; su contabilidad deberá ser pública; las fuentes de su financiamiento no podrán provenir de dineros, bienes, donaciones, aportes ni créditos de origen extranjero; sus estatutos deberán contemplar las normas que aseguren una efectiva democracia interna. Una ley orgánica constitucional establecerá un sistema de elecciones primarias que podrá ser utilizado por dichos partidos para la nominación de candidatos a cargos de elección popular, cuyos resultados serán vinculantes para estas colectividades, salvo las excepciones que establezca dicha ley. Aquellos que no resulten elegidos en las elecciones primarias no podrán ser candidatos, en esa elección, al respectivo cargo. Una ley orgánica constitucional regulará las demás materias que les conciernan y las sanciones que se aplicarán por el incumplimiento de sus preceptos, dentro de las cuales podrá considerar su disolución. Las asociaciones, movimientos, organizaciones o grupos de personas que persigan o realicen actividades propias de los partidos políticos sin ajustarse a las normas anteriores son ilícitos y serán sancionados de acuerdo a la referida ley orgánica constitucional.
La Constitución Política garantiza el pluralismo político. Son inconstitucionales los partidos, movimientos u otras formas de organización cuyos objetivos, actos o conductas no respeten los principios básicos del régimen democrático y constitucional, procuren el establecimiento de un sistema totalitario, como asimismo aquellos que hagan uso de la violencia, la propugnen o inciten a ella como método de acción política. Corresponderá al Tribunal Constitucional declarar esta inconstitucionalidad.
