- English1. There shall be a Constitutional Court which is an independent body composed of a President, Vice-President and three members, who -as well as the three deputy members -shall be appointed for a period of five years at the recommendation of the National Assembly.
2. The tasks of the Constitutional Court shall be:
a. to verify the purport of Acts or parts thereof against the Constitution, and against applicable agreements concluded with other states and with international organization;
b. to assess the consistency of decisions of government institutions with one or more of the constitutional rights mentioned in Chapter V3.

Where any question as to the interpretation of this Constitution arises in any court of law established for Antigua and Barbuda (other than the Court of Appeal, the High Court or a court-martial) and the court is of the opinion that the question involves a substantial question of law, the court may, and shall if any party to the proceedings so requests, refer the question to the High Court.

- EnglishIn specific cases, in every process of whatever competence or jurisdiction, in any instance and in cassation and even before a sentence is decreed, the parties will be able to present as an action [acción], plea [excepción], or incidental issue [incidente], the total or partial unconstitutionality of a law. The disputes that Article 103 of the Constitution concerns, with the exception of those in electoral matters, will be subject to the procedures and formalities [formas] of the juridical order that the law determines, in accordance with the following bases:
I. - EnglishIt will correspond to a specialized Chamber of the Supreme Court of Justice to declare, by absolute majority of its members, the unconstitutionality of the norms of any nature and of the acts subject to the Public Law. The jurisdictional acts of the Judicial Power, the declaration of election made by the Supreme Tribunal of Elections and the others determined by the law[,] will not be impugnable by this way.
It will also correspond to it:
a. To settle the conflicts of competence between the powers of the State, the Supreme Tribunal of Elections included, as well as with the other entities or organs that the law indicates.
b. To take cognizance of the consultations on bills of constitutional reform, of approval of international agreements or treaties and of other bills of law, as provided in the law. (Art. 10) - SpanishCorresponderá a una Sala especializada de la Corte Suprema de Justicia declarar, por mayoría absoluta de sus miembros, la inconstitucionalidad de las normas de cualquier naturaleza y de los actos sujetos al Derecho Público. No serán impugnables en esta vía los actos jurisdiccionales del Poder Judicial, la declaratoria de elección que haga el Tribunal Supremo de Elecciones y los demás que determine la ley.
Le corresponderá además:
a) Dirimir los conflictos de competencia entre los poderes del Estado, incluido el Tribunal Supremo de Elecciones, así como con las demás entidades y órganos que indique la ley.
b) Conocer de las consultas sobre proyectos de reforma constitucional, de aprobación de convenios o tratados internacionales y de otros proyectos de ley, según se disponga en la ley. (Art. 10)
