The organic laws and the ordinances concerning the domain arising from the organic law are submitted by the Prime Minister to the Constitutional Court before their promulgation or their publication.The other categories of law, the ordinances as well as the regulatory acts that supposedly infringe the fundamental rights of the human person and the public freedoms may be deferred to the Constitutional Court, either by the President of the Republic, or by the Prime Minister, or by the Presidents of the Chambers of Parliament or one-tenth (1/10) of the members of each Chamber, or by the Presidents of the Court of Cassation, of the Council of State and of the Court of Accounts, or by any citizen or any juridical person prejudiced by the law or the ordinance contested.

- EnglishAny person may seek amparo before the Constitutional Chamber of the Supreme Court of Justice for violation of the rights granted by this Constitution.
The habeas corpus may be sought before the Constitutional Chamber of the Supreme Court of Justice or before the Chambers of Second Instance that do not reside in the capital. The resolution of the Chamber that denies the freedom of the favored person [favorecido] may be the object of review [revisión], at the request of the interested party, by the Constitutional Chamber of the Supreme Court of Justice. The Constitutional Council is referred to [a matter] by:
• the President of Faso;
• the Prime Minister;
• the President of the National Assembly;
• one-tenth (1/10) at least of the members of the National Assembly.
In addition, any citizen may refer [a matter] to the Constitutional Council concerning the constitutionality of the laws, either directly, or through the procedure of the pleadings [exception] of unconstitutionality invoked in a matter [affaire] which concerns them before a jurisdiction. This must postpone [the matter] until the decision of the Constitutional Council which must intervene within a maximum period of time of thirty days counting from its referral [to the matter].
The Constitutional Council can refer itself to any questions relative to its competence, if it judges it necessary. (Art. 157) - French
Le Conseil constitutionnel est saisi par :
• le Président du Faso;
• le Premier ministre;
• le Président de l'Assemblée nationale;
• un dixième (1/10) au moins des membres de chaque chambre du Parlement.
En outre, tout citoyen peut saisir le Conseil constitutionnel sur la constitutionnalité des lois, soit directement, soit par la procédure de l’exception d’inconstitutionnalité invoquée dans une affaire qui le concerne devant une juridiction. Celle-ci doit surseoir jusqu’à la décision du Conseil constitutionnel qui doit intervenir dans un délai maximum de trente jours à compter de sa saisine.
Le Conseil constitutionnel peut se saisir de toutes questions relevant de sa compétence s’il le juge nécessaire. (Art. 157)

- English(1) If a court concludes that a law on whose validity its decision depends is unconstitutional, the proceedings shall be stayed, and a decision shall be obtained from the Land court with jurisdiction over constitutional disputes where the constitution of a Land is held to be violated, or from the Federal Constitutional Court where this Basic Law is held to be violated. This provision shall also apply where the Basic Law is held to be violated by Land law and where a Land law is held to be incompatible with a federal law.
(2) If, in the course of litigation, doubt exists whether a rule of international law is an integral part of federal law and whether it directly creates rights and duties for the individual (Article 25), the court shall obtain a decision from the Federal Constitutional Court.
(3) If the constitutional court of a Land, in interpreting this Basic Law, proposes to deviate from a decision of the Federal Constitutional Court or of the constitutional court of another Land, it shall obtain a decision from the Federal Constitutional Court. (Art. 100) - German(1) Hält ein Gericht ein Gesetz, auf dessen Gültigkeit es bei der Entscheidung ankommt, für verfassungswidrig, so ist das Verfahren auszusetzen und, wenn es sich um die Verletzung der Verfassung eines Landes handelt, die Entscheidung des für Verfassungsstreitigkeiten zuständigen Gerichtes des Landes, wenn es sich um die Verletzung dieses Grundgesetzes handelt, die Entscheidung des Bundesverfassungsgerichtes einzuholen. Dies gilt auch, wenn es sich um die Verletzung dieses Grundgesetzes durch Landesrecht oder um die Unvereinbarkeit eines Landesgesetzes mit einem Bundesgesetz handelt.
(2) Ist in einem Rechtsstreite zweifelhaft, ob eine Regel des Völkerrechtes Bestandteil des Bundesrechtes ist und ob sie unmittelbar Rechte und Pflichten für den Einzelnen erzeugt (Artikel 25), so hat das Gericht die Entscheidung des Bundesverfassungsgerichtes einzuholen.
(3) Will das Verfassungsgericht eines Landes bei der Auslegung des Grundgesetzes von einer Entscheidung des Bundesverfassungsgerichtes oder des Verfassungsgerichtes eines anderen Landes abweichen, so hat das Verfassungsgericht die Entscheidung des Bundesverfassungsgerichtes einzuholen. (Art. 100)

Whenever the executive returns a bill, it shall again be debated in the National Congress, and if it is ratified by a two-thirds vote, it shall again be sent to the executive branch, with this phrase: “Constitutionally ratified” and the executive branch shall publish it forthwith.

Cuando el Ejecutivo devolviere el proyecto, el Congreso Nacional lo someterá a nueva deliberación, y si fuere ratificado por (2/3) dos tercios de votos, lo pasará de nuevo al Poder Ejecutivo, con esta fórmula: "Ratificado Constitucionalmente" y, éste lo publicará sin tardanza.

– to judge the constitutionality of the organic and ordinary laws, already promulgated or simply voted, of the regulations as well as of the Internal Regulations of the National Assembly and of the Senate;
– to take cognizance of electoral disputes;
– to see to the regularity of the electoral consultations, [and] to examine and to proclaim the definitive results;
– to see to the regularity of the operations of [the] referendum, to examine the complaints and to proclaim the definitive results;
– to receive the oath of the President of the Republic elected;
– to determine the conflicts of competence within the executive power, between the legislative and executive powers and between the State and the territorial collectivities;
– to declare the errors [constater des défauts] of promulgation of the laws definitively voted and the lack of their promulgation in order to permit their entry into force;
– to interpret the Constitution;
– to give its opinion concerning the bills or proposals of constitutional revision and the procedure of [the] referendum;

- connaître du contentieux électoral;
