The President of the Republic may ask the Constitutional Court to conduct a prior review of the constitutionality of any rule contained in legislation that has been submitted for enactment, any international treaty submitted to him for ratification or any international agreement sent to him for signature.
2. One tenth of the Members of the National Assembly in full exercise of their office may also request a prior review of the constitutionality of any rule contained in legislation that has been submitted for enactment.

The Constitutional Council is referred to [a matter] by:
• the President of Faso;
• the Prime Minister;
• the President of the National Assembly;
• one-tenth (1/10) at least of the members of the National Assembly.
In addition, any citizen may refer [a matter] to the Constitutional Council concerning the constitutionality of the laws, either directly, or through the procedure of the pleadings [exception] of unconstitutionality invoked in a matter [affaire] which concerns them before a jurisdiction. This must postpone [the matter] until the decision of the Constitutional Council which must intervene within a maximum period of time of thirty days counting from its referral [to the matter].

Le Conseil constitutionnel est saisi par :

• un dixième (1/10) au moins des membres de chaque chambre du Parlement.
En outre, tout citoyen peut saisir le Conseil constitutionnel sur la constitutionnalité des lois, soit directement, soit par la procédure de l’exception d’inconstitutionnalité invoquée dans une affaire qui le concerne devant une juridiction. - English(1) The Constitutional Council shall give a final ruling on:
- the constitutionality of laws, treaties and international agreements;
- the constitutionality of the standing orders of the National Assembly and the Senate prior to their implementation;
- conflict of powers between State institutions; between the State and the Regions, and between the Regions.
(2) Matters may be referred to the Constitutional Council by the President of the Republic, the President of the National Assembly, the President of the Senate, one-third of the members of the National Assembly or one-third of the Senators.
Presidents of regional executives may refer matters to the Constitutional Council whenever the interests of their Regions are at stake.
(3) Laws as well as treaties and international agreements may, prior to their enactment, be referred to the Constitutional Council by the President of the Republic, the President of the National Assembly, the President of the Senate, one-third of the members of the National Assembly, one third of the Senators, or the Presidents of the regional executives pursuant to the provisions of paragraph (2) above.

1. The Council of Constitutional Inquiry shall have powers to investigate constitutional disputes. Should the Council, upon consideration of the matter, find it necessary to interpret the Constitution, it shall submit its recommendations thereon to the House of the Federation.
2. Where any Federal or State law is contested as being unconstitutional and such a dispute is submitted to it by any court or interested party, the Council shall consider the matter and submit it to the House of the Federation for a final decision.
3. When issues of constitutional interpretation arise in the courts, the Council shall:
a. Remand the case to the concerned court if it finds there is no need for constitutional interpretation; the interested party, if dissatisfied with the decision of the Council, may appeal to the House of the Federation.
b. Submit its recommendations to the House of the Federation for a final decision if it believes there is a need for constitutional interpretation.

Any pleader [plaideur] may raise the exception of unconstitutionality of a law before any jurisdiction.
The jurisdiction referred to [the matter] postpones deciding and remits the exception before the Constitutional Court. In this case, the Constitutional Court decides in the fifteen days of its referral.
The Constitutional Court is the judge of the violations of the fundamental rights and public freedoms committed by the public powers, the agents of the State and the citizens. It can be referred to [the matter] by the National Institution of Human Rights.

The High Court shall have original jurisdiction to review any law, and any action or decision of the Government, for conformity with this Constitution, save as otherwise provided by this Constitution and shall have such other jurisdiction and powers as may be conferred on it by this Constitution or any other law. 2. The following may request the Constitutional Council to pronounce upon the unconstitutionality of laws, or on the illegality of normative acts of State offices:
a. the President of the Republic;
b. the President of the Assembly of the Republic;
c. at least one third of the deputies of the Assembly of the Republic;
d. the Prime Minister;
e. the Attorney General of the Republic;
