- EnglishThe Constitutional Court is the jurisdiction competent in constitutional and electoral matters.
It is charged with deciding on the constitutionality of the laws, of the ordinances as well as of the conformity of international treaties and agreements with the Constitution.
It interprets the provisions of the Constitution. It controls the regularity, the transparency and the honesty [sincérité] of the referendum, [and] of the presidential and legislative elections. It is [the] judge of the electoral disputes [contentieux] and proclaims the definitive results of the elections. (Art. 120) - FrenchLa Cour constitutionnelle est la juridiction compétente en matière constitutionnelle et électorale.
Elle est chargée de statuer sur la constitutionnalité des lois, des ordonnances ainsi que de la conformité des traités et accords internationaux à la Constitution.

Beside the other attributions which are expressly conferred on it by other provisions of the Constitution, the Constitutional Court decides by an decision on the constitutionality of the treaties, the laws and the regulations.
The Constitutional Court may be referred to [the matter] of the constitutionality of the treaties before their ratification, and of the laws before their promulgation.
The Constitutional Court may be referred to [the matter] of the constitutionality of the regulations within a time period of one month, counting from the date of their publication.
The Constitutional Court decides equally by decision on the conventionality of the laws and of the regulations within the conditions established respectively in paragraphs 2 and 3 above.
The Constitutional Court is obligatorily referred to [the matter] of the conformity of the organic laws with the Constitution by the President of the Republic after their adoption by the Parliament. It decides by a decision on the whole of the text.

Outre les autres attributions qui lui sont expressément conférées par d’autres dispositions de la Constitution, la Cour constitutionnelle se prononce par une décision sur la constitutionnalité des traités, des lois et des règlements.

- English(1) The Constitutional Court—
(a) is the highest court in all constitutional matters, and its decisions on those matters bind all other courts;
(b) decides only constitutional matters and issues connected with decisions on constitutional matters, in particular references and applications under section 131(8)(b) and paragraph 9(2) of the Fifth Schedule3; and
(c) makes the final decision whether a matter is a constitutional matter or whether an issue is connected with a decision on a constitutional matter.
(2) Subject to this Constitution, only the Constitutional Court may—
(a) advise on the constitutionality of any proposed legislation, but may do so only where the legislation concerned has been referred to it in terms of this Constitution;

(d) determine whether Parliament or the President has failed to fulfil a constitutional obligation.
(3) The Constitutional Court makes the final decision whether an Act of Parliament or conduct of the President or Parliament is constitutional, and must confirm any order of constitutional invalidity made by another court before that order has any force.
(4) An Act of Parliament may provide for the exercise of jurisdiction by the Constitutional Court and for that purpose may confer the power to make rules of court.
(5) Rules of the Constitutional Court must allow a person, when it is in the interests of justice and with or without leave of the Constitutional Court—
(a) to bring a constitutional matter directly to the Constitutional Court;
(b) to appeal directly to the Constitutional Court from any other court;

If the Constitutional Council, referred [to the matter] by the President of the Republic, the President of the National Assembly or of the Senate or by one-tenth at least of the Deputies or of the Senators, has declared that an international treaty or agreement includes a clause contrary to the Constitution, the authorization to ratify it can take place only after revision of the Constitution. (a) an enactment or anything contained in or done under the authority of that or any other enactment; or
(b) any act or omission of any person;
is inconsistent with, or is in contravention of a provision of this Constitution, may bring an action in the Supreme Court for a declaration to that effect.
(2) The Supreme Court shall, for the purposes of a declaration under clause (1) of this article, make such orders and give such directions as it may consider appropriate for giving effect, or enabling effect to be given, to the declaration so made.

- EnglishThe Supreme Court shall be final arbiter of constitutional issues and shall exercise final appellate jurisdiction in all cases whether emanating from courts of record, courts not of record, administrative agencies, autonomous agencies or any other authority, both as to law and fact except cases involving ambassadors, ministers, or cases in which a country is a party. In all such cases, the Supreme Court shall exercise original jurisdiction.
