(1) The Constitutional Court shall decide on complaints of the bodies of territorial self-administration against unconstitutional or unlawful decision or against other unconstitutional or unlawful action into the matters of self-administration, save another court shall decide on its protection.

(1) Subsection (2) applies in any proceedings in which a court determines whether a provision of primary legislation is compatible with a Convention right.
(2) If the court is satisfied that the provision is incompatible with a Convention right, it may make a declaration of that incompatibility.
(3) Subsection (4) applies in any proceedings in which a court determines whether a provision of subordinate legislation, made in the exercise of a power conferred by primary legislation, is compatible with a Convention right.
(4) If the court is satisfied—
(a) that the provision is incompatible with a Convention right, and
(b) that (disregarding any possibility of revocation) the primary legislation concerned prevents removal of the incompatibility,it may make a declaration of that incompatibility.
(5) In this section “court” means—
(a) the Supreme Court;
(b) the Judicial Committee of the Privy Council;
(c) the Court Martial Appeal Court;
(d) in Scotland, the High Court of Justiciary sitting otherwise than as a trial court or the Court of Session;
(e) in England and Wales or Northern Ireland, the High Court or the Court of Appeal.
(f) the Court of Protection, in any matter being dealt with by the President of the Family Division, the Chancellor of the High Court] or a puisne judge of the High Court.

The Constitutional Court pronounces whether state treaties are unlawful. Art. 140 shall apply to political, to law-modifying and to law-amending state treaties and to state treaties modifying the Treaty basis of the European Union, Art. 139 to all other state treaties with the following proviso,

- EnglishIf the Chancellor of Justice finds that a legislative instrument passed by the legislative or executive branch of government or by a local authority is in conflict with the Constitution or a law, he or she makes a proposal to the body which passed the instrument to bring it into conformity with the Constitution or the law within twenty days. If the instrument is not brought into conformity with the Constitution or the law within twenty days, the Chancellor of Justice refers the matter to the Supreme Court who may declare the instrument invalid. To the same end, Acts of Parliament may be referred to the Constitutional Council, before their promulgation, by the President of the Republic, the Prime Minister, the President of the National Assembly, the President of the Senate, sixty Members of the National Assembly or sixty Senators.

(1) The Constitutional Court decides, by means of [an] order [arret], on the conformity of laws with the Constitution.
(2) The Constitutional Court may be referred to [a matter], under title of preliminary opinion [titre prejudiciel], following the modalities to be determined by the law, by any jurisdiction to decide on the conformity of the laws, with the exception of the laws concerning approval of treaties, with the Constitution.
(3) The Constitutional Court will regulate the disputes of attribution according to the mode determined by the law.
(4) The attributions of the Constitutional Court may be extended by a law voted by a qualified majority gathering at least two-thirds of the votes of the members of the chamber of deputies, the vote by proxy not being admitted.

In accordance with principles specified by statute, everyone whose constitutional freedoms or rights have been infringed, shall have the right to appeal to the Constitutional Tribunal for its judgment on the conformity to the Constitution of a statute or another normative act upon which basis a court or organ of public administration has made a final decision on his freedoms or rights or on his obligations specified in the Constitution.

1. Recourse to the Constitutional Court is sought upon the request of the:
a) President of the Republic;
b) Prime Minister;
c) Not less than one-fifth of the members of Assembly;
ç) Peoples Advocate;
d) Head of High State Audit;
dh) Any court, as per the provisions of Article 145, paragraph 2, of this Constitution;
e) Any commissioner established by law for the protection of the fundamental rights and freedoms guaranteed by the Constitution;
ë) High Judicial Council and High Prosecutorial Council;
f) Local governance units;
g) Organs of religious communities;
gj) Political parties;
h) Organizations;
i) Individuals.
2. The entities provided for in subparagraphs “d”, “dh”, “e”, “ë”, “f”, “g”, “gj”, “h”, and “i” of paragraph 1 of this Article may file a request only regarding the issues connected to their interests. (Art. 134) - Albanian
