Composition and Appointment
- English(1) A person shall be qualified for appointment as Chief Justice if he or she is qualified to be appointed a judge of the Supreme Court and has been a judge of a superior court in a common law country for not less than ten years.
(2) A person shall be qualified to be appointed a judge of the Supreme Court if he or she holds or has held office as a judge of the Court of Appeal, or as a judge of a court having similar jurisdiction in a common law country, in each case for not less than five years, or if he or she has practised as a legal practitioner before a court having unlimited jurisdiction in civil and criminal matters in a common law country for not less than twelve years.

- EnglishAny person may file an initiative to start the procedure for the assessment of constitutionality and legality.
The procedure before the Constitutional Court for the assessment of constitutionality and legality may be initiated by the court, other state authority, local self-government authority and five Members of the Parliament.
The Constitutional Court itself may also initiate the procedure for the assessment of constitutionality and legality.
During the procedure, the Constitutional Court may order to stop the enforcement of an individual act or actions that have been taken on the basis of the law, other regulation or general act, the constitutionality, i.e. legality of which is being assessed, if the enforcement thereof could cause irreparable damage. Postupak pred Ustavnim sudom za ocjenu ustavnosti i zakonitosti može da pokrene sud, drugi državni organ, organ lokalne samouprave i pet poslanika.

- EnglishThe declaration of the unconstitutionality of a law and the inapplicability of the provisions affected thereby, may be requested by any person who considers that his direct, personal, and legitimate interest is injured:
1. By means of lawsuit, which must be filed before the Supreme Court of Justice;
2. By plea of exception, which may be made in any judicial proceeding.
A judge or court which hears any judicial proceeding, or the Contentious-Administrative Tribunal, as the case may be, may also request the declaration of unconstitutionality of a law and its inapplicability, before rendering a decision.
In this case and in that provided in subparagraph 2 above, the proceedings shall be suspended and the case referred to the Supreme Court of Justice. (Art. 258) - SpanishLa declaración de inconstitucionalidad de una ley y la inaplicabilidad de las disposiciones afectadas por aquélla, podrán solicitarse por todo aquel que se considere lesionado en su interés directo, personal y legítimo:
