Composition and Appointment
- English(1) The President may appoint a woman or man to serve as an acting Deputy Chief Justice or judge of the Constitutional Court if there is a vacancy in any of those offices, or if the person holding such an office is absent. The appointment must be made on the recommendation of the Cabinet member responsible for the administration of justice acting with the concurrence of the Chief Justice, and an appointment as acting Deputy Chief Justice must be made from the ranks of the judges who had been appointed to the Constitutional Court in terms of section 174(4).

- EnglishA constitutional appeal against the acts of public authorities impairing fundamental rights may be lodged by:
a) Those having been party or accessory to the previous legal proceedings referred to in article 41.2 of this Constitution.
b) Those having a legal interest relating to non-enforceable provisions or acts of the General Council.

- English(1) A person who alleges that an enactment or anything contained in or done under the authority of that or any other enactment is inconsistent with, or is in contravention of a provision of this Constitution, may at any time bring an action in the Supreme Court for a declaration to that effect.
(2) The Supreme Court shall, for the purposes of a declaration under subsection (1), make such orders and give such directions as it may consider appropriate for giving effect to, or enabling effect to be given to, the declaration so made.

- EnglishIf the High Court Division is satisfied that a case pending in a court subordinate to it involves a substantial question of law as to the interpretation of this Constitution, or on a point of general public importance, the determination of which is necessary for the disposal of the case, it shall withdraw the case from that court and may –
(a) either dispose of the case itself ; or
(b) determine the question of law and return the case to the court from which it has been so withdrawn (or transfer it to another subordinate court) together with a copy of the judgment of the division on such question, and the court to which the case is so returned or transferred shall, on receipt thereof, proceed to dispose of the case in conformity with such judgment. controversies on the constitutional legitimacy of laws and measures having force of law issued by the State and Regions;
conflicts of authority between central institutions, between State and Regions, and between Regions;
charges brought against the President of the Republic, according to the provisions of the Constitution. (Art. 134) - Italian
