Composition and Appointment
- English(1) The President may appoint a woman or man to serve as an acting Deputy Chief Justice or judge of the Constitutional Court if there is a vacancy in any of those offices, or if the person holding such an office is absent. The appointment must be made on the recommendation of the Cabinet member responsible for the administration of justice acting with the concurrence of the Chief Justice, and an appointment as acting Deputy Chief Justice must be made from the ranks of the judges who had been appointed to the Constitutional Court in terms of section 174(4).

2. The House of the Federation shall, within thirty days of receipt, decide a constitutional dispute submitted to it by the Council of Constitutional Inquiry. - EnglishThe organic laws are obligatorily submitted by the President of the Republic to the Constitutional Court before their promulgation.
The ordinary laws, before their promulgation, may be referred to the Constitutional Court either by the President of the Republic or by the President of the National Assembly or by one-tenth of the Deputies. - EnglishThe Constitutional Court is the highest jurisdiction of the State in constitutional matters. It is given the charge:
– to judge the constitutionality of the organic and ordinary laws, already promulgated or simply voted, of the regulations as well as of the Internal Regulations of the National Assembly and of the Senate;
– to take cognizance of electoral disputes;
– to see to the regularity of the electoral consultations, [and] to examine and to proclaim the definitive results;
– to see to the regularity of the operations of [the] referendum, to examine the complaints and to proclaim the definitive results;
– to receive the oath of the President of the Republic elected;
– to determine the conflicts of competence within the executive power, between the legislative and executive powers and between the State and the territorial collectivities;

– to interpret the Constitution;
– to give its opinion concerning the bills or proposals of constitutional revision and the procedure of [the] referendum;

- EnglishIn specific cases, in every process of whatever competence or jurisdiction, in any instance and in cassation and even before a sentence is decreed, the parties will be able to present as an action [acción], plea [excepción], or incidental issue [incidente], the total or partial unconstitutionality of a law. The tribunal must decide concerning it. (Art. 266)

- EnglishAny person may file an initiative to start the procedure for the assessment of constitutionality and legality.
The procedure before the Constitutional Court for the assessment of constitutionality and legality may be initiated by the court, other state authority, local self-government authority and five Members of the Parliament.
The Constitutional Court itself may also initiate the procedure for the assessment of constitutionality and legality.
During the procedure, the Constitutional Court may order to stop the enforcement of an individual act or actions that have been taken on the basis of the law, other regulation or general act, the constitutionality, i.e. legality of which is being assessed, if the enforcement thereof could cause irreparable damage. Postupak pred Ustavnim sudom za ocjenu ustavnosti i zakonitosti može da pokrene sud, drugi državni organ, organ lokalne samouprave i pet poslanika.
Ustavni sud može i sâm pokrenuti postupak za ocjenu ustavnosti i zakonitosti.
U toku postupka, Ustavni sud može narediti da se obustavi izvršenje pojedinačnog akta ili radnje koji su preduzeti na osnovu zakona, drugog propisa ili opšteg akta čija se ustavnost ili zakonitost ocjenjuje, ako bi njihovim izvršenjem mogle nastupiti neotklonjive štetne posljedice. (Član 150)

- English1. Appropriate principles of interpretation of this Constitution shall be developed and employed by the courts to reflect the unique character and supreme status of this Constitution.
2. In interpreting the provisions of this Constitution a court of law shall—
a. promote the values which underlie an open and democratic society;
b. take full account of the provisions of Chapter III and Chapter IV2; and
c. where applicable, have regard to current norms of public international law and comparable foreign case law.
3. Where a court of law declares an act of executive or a law to be invalid, that court may apply such interpretation of that act or law as is consistent with this Constitution.
4. Any law that ousts or purports to oust the jurisdiction of the courts to entertain matters pertaining to this Constitution shall be invalid. (Sec. 11)
