- EnglishThe functions and the duties of the Constitutional Tribunal of the Union are as follows:
(a) interpreting the provisions under the Constitution;
(b) vetting whether the laws promulgated by the Pyidaungsu Hluttaw, the Region Hluttaw, the State Hluttaw or the Self-Administered Division Leading Body and the Self-Administered Zone Leading Body are in conformity with the Constitution or not;
(c) vetting whether the measures of the executive authorities of the Union, the Regions, the States, and the Self-Administered Areas are in conformity with the Constitution or not;
(d) deciding Constitutional disputes between the Union and a Region, between the Union and a State, between a Region and a State, among the Regions, among the States, between a Region or a State and a Self-Administered Area and among the Self-Administered Areas;
(e) deciding disputes arising out of the rights and duties of the Union and a Region, a State or a Self-Administered Area in implementing the Union Law by a Region, State or Self-Administered Area;
(f) vetting and deciding matters intimated by the President relating to the Union Territory;
(g) functions and duties conferred by laws enacted by the Pyidaungsu Hluttaw. (Sec. 322) - Burmeseနိုင်ငံတော်ဖွဲ့စည်းပုံအခြေခံဥပဒေဆိုင်ရာ ခုံရုံး၏ လုပ်ငန်းတာဝန်များမှာ အောက်ပါအတိုင်း ဖြစ်သည်

(ဂ) ပြည်ထောင်စု၊ တိုင်းဒေသကြီးများ၊ ပြည်နယ်များနှင့် ကိုယ်ပိုင်အုပ်ချုပ်ခွင့်ရ စီရင်စုများ၏ အုပ်ချုပ်မှုဆိုင်ရာအာဏာပိုင်းများ၏ ဆောင်ရွက်ချက်များသည် ဖွဲ့စည်းပုံအခြေခံဥပဒေနှင့် ညီညွှတ်ခြင်း ရှိ - မရှိ စိစစ်ခြင်း၊
(ဃ) ပြည်ထောင်စုနှင့် တိုင်းဒေသကြီးအကြား၊ ပြည်ထောင်စုနှင့် ပြည်နယ်အကြား၊ တိုင်းဒေသကြီးနှင့် ပြည်နယ်အကြား၊ တိုင်းဒေသကြီးအချင်းချင်း၊ ပြည်နယ်အချင်းချင်း၊ တိုင်းဒေသကြီး သို့မဟုတ် ပြည်နယ်နှင့် ကိုယ်ပိုင်အုပ်ချုပ်ခွင့်ရ စီရင်စုအကြား၊ ကိုယ်ပိုင်အုပ်ချုပ်ခွင့်ရစီရင်စုအချင်းချင်း ဖြစ်ပေါ် သည့် ဖွဲ့စည်းပုံအခြေခံဥပဒေဆိုင်ရာ အငြင်းပွားမှုများကို ဆုံးဖြတ်ခြင်း၊
(င) တိုင်းဒေသကြီး၊ ပြည်နယ် သို့မဟုတ် ကိုယ်ပိုင်အုပ်ချုပ်ခွင့်ရစီရင်စုတို့က ပြည်ထောင်စုဥပဒေကို အကောင်အထည် ဖော်ဆောင်ရွက်ရာတွင် ပြည်ထောင်စုနှင့်တိုင်းဒေသကြီး၊ ပြည်နယ်သို့မဟုတ်ကိုယ်ပိုင်အုပ်ချုပ်ခွင့်ရစီရင်စုတို့၏ အခွင့်အရေးနှင့် တာဝန်များနှင့် စပ်လျဉ်း၍ ပေါ်ပေါက်သည့် အငြင်းပွားမှုများကို ဆုံးဖြတ်ခြင်း၊
(စ) ပြည်ထောင်စုနယ်မြေများနှင့် စပ်လျဉ်း၍ နိုင်ငံတော်သမ္မတက အကြောင်းကြားလာသည့် ကိစ္စရပ် များကို စိစစ်ဆုံးဖြတ်ခြင်း၊
(ဆ) ပြည်ထောင်စုလွှတ်တော်က ပြဌာန်းသည့်ဥပဒေများက ပေးအပ်သည့် လုပ်ငန်းတာဝန်များ။ (ပုဒ်မ-၃၂၂)

- English1 The Federal Supreme Court hears disputes concerning violations of:
a. federal law;
b. international law;
c. inter-cantonal law;
d. cantonal constitutional rights;
e. the autonomy of the communes and other cantonal guarantees in favour of public law corporations;
f. federal and cantonal provisions on political rights.
2 It hears disputes between the Confederation and Cantons or between Cantons.
3 The jurisdiction of the Federal Supreme Court may be extended by law.
4 Acts of the Federal Assembly or the Federal Council may not be challenged in the Federal Supreme Court. Exceptions may be provided for by law. (Art. 189) - French1 Le Tribunal fédéral connaît des contestations pour violation:

2 Es beurteilt Streitigkeiten zwischen Bund und Kantonen oder zwischen Kantonen.
3 Das Gesetz kann weitere Zuständigkeiten des Bundesgerichts begründen.
4 Akte der Bundesversammlung und des Bundesrates können beim Bundesgericht nicht angefochten werden. Ausnahmen bestimmt das Gesetz. (Art. 189) - Italian1 Il Tribunale federale giudica le controversie per violazione:
a. del diritto federale;
b. del diritto internazionale;
c. del diritto intercantonale;
d. dei diritti costituzionali cantonali;

2 Il Tribunale federale giudica inoltre le controversie tra la Confederazione e i Cantoni e quelle tra Cantoni.

At the request of the President of the Republic or, on the grounds of infringement of the laws of the Autonomous Region of Príncipe, of the Chairman of the Regional Legislative, the Constitutional Court shall review and verify non-compliance with the Constitution by omission of the legislative measures necessary for making the constitutional rules enforceable.
2. Whenever the Constitutional Court verifies the existence of unconstitutionality by omission, it shall notify the appropriate legislative body. (Art. 148) - Portuguese1. A requerimento do Presidente da República ou, com fundamento em violação de direitos da Região Autónoma do Príncipe, do Presidente da Assembleia Legislativa Regional, o Tribunal Constitucional aprecia e verifica o não cumprimento da Constituição por omissão das medidas legislativas necessárias para tornar exequíveis as normas constitucionais.
2. Quando o Tribunal Constitucional verificar a existência da inconstitucionalidade por omissão, dará disso conhecimento ao órgão legislativo competente. (Art. 148)

(a) original jurisdiction in matters relating to application, contravention, enforcement interpretation of this Constitution;

- EnglishA Constitutional Court shall be established, and shall comprise a President and six members, all of whom are appointed by a Royal Order for a period specified by the law. The court’s area of competence is to watch over the constitutionality of laws and statutes.
The law shall state the regulations that ensure that the members of the Court are not liable to dismissal, and specifies the procedures that are followed before the Court. The law shall guarantee the right of the Government, Consultative Council, the Chamber of Deputies and notable individuals and others to challenge before the Court the constitutionality of laws and statutes. …

- EnglishThe appellate division of the Supreme Court may review cases heard in the national courts, and cases heard in state or local courts if they require interpretation of this Constitution, national law, or a treaty. If a state constitution permits, the appellate division of the Supreme Court may review other cases on appeal from the highest state court in which a decision may be had. (Art. XI, Sec. 7)

- English1. The Supreme Court shall be the custodian of this Constitution and the constitutions of the states.
2. The Supreme Court shall exercise competences as follows:
a. interpret constitutional provisions at the instance of the President, Government of South Sudan, any state government, or any of the two Houses of the National Legislature;
b. be the court of final judicial instance in respect of any litigation or prosecution under National or state law, including statutory and customary law;
c. have original jurisdiction to decide on disputes that arise under this Constitution and the constitutions of states at the instance of individuals, juridical entities or governments;
d. adjudicate on the constitutionality of laws and set aside or strike down laws or provisions of laws that are inconsistent with this Constitution or the constitutions of the states to the extent of the inconsistency;
e. be a court of review and cassation in respect of any criminal, civil and administrative matters arising out of or under the law;
f. have criminal jurisdiction over the President in accordance with Article 103 (2) herein;
g. have criminal jurisdiction over the Vice President, the Speakers of the National Legislative Assembly and the Council of States and the Justices of the Supreme Court;
h. review death sentences imposed by courts in respect of offences committed under the law;
i. receive appeals against decisions and judgments of the courts of appeal;
j. have original and final jurisdiction to resolve disputes between the states and between the National Government and a state in respect of areas of exclusive, concurrent or residual competences;
k. uphold and protect human rights and fundamental freedoms; and
l. have such other competences as prescribed by this Constitution and the law.

The President of the Republic with regard to any law or decision of the Greek Communal Chamber and the Vice-President of the Republic with regard to any law or decision of the Turkish Communal Chamber, may, at any time prior to the publication of such law or decision, refer to the Supreme Constitutional Court for its opinion the question as to whether such law or decision or any specified provision thereof is repugnant to or inconsistent with any provision of this Constitution.
