- English1. Preventive review of the constitutionality may be requested from the Constitutional Court:
a) By the President of the Republic, in respect of any rule contained in an international treaty or agreement that is referred to it for ratification, as well as in respect of any provision of legislation it has been sent for promulgation as a law, legislative decree or decree-law;
b) By, at least, fifteen Deputies in full exercise of their functions or by the Prime Minister in respect of any rule contained in a legislation act sent to the President for promulgation as law subject to approval by a qualified majority.

2. The House of the Federation shall, within thirty days of receipt, decide a constitutional dispute submitted to it by the Council of Constitutional Inquiry. - EnglishProceedings for failure to comply shall be aimed at guaranteeing the application of rules and regulations comprising the legal system, as well as compliance with the rulings or reports of international human rights organizations, when the regulation or decision whose enforcement is being pursued contains an obligation to make it clear, express and enforceable. - English(1) There shall be in and for Malta such Superior Courts having such powers and jurisdiction as may be provided by any law for the time being in force in Malta.
(2) One of the Superior Courts, composed of such three judges as could, in accordance with any law for the time being in force in Malta, compose the Court of Appeal, shall be known as the Constitutional Court and shall have jurisdiction to hear and determine –
(a) such questions as are referred to in article 63 of the Constitution;
(b) any reference made to it in accordance with article 56 of this Constitution and any matter referred to it in accordance with any law relating to the election of members of the House of Representatives;
(c) appeals from decisions of the Civil Court, First Hall, under article 46 of this Constitution;
(d) appeals from decisions of any court of original jurisdiction in Malta as to the interpretation of this Constitution other than those which may fall under article 46 of this Constitution;
(e) appeals from decisions of any court of original jurisdiction in Malta on questions as to the validity of laws other than those which may fall under article 46 of this Constitution; and
(f) any question decided by a court of original jurisdiction in Malta together with any of the questions referred to in the foregoing paragraphs of this sub-article on which an appeal has been made to the Constitutional Court:
Provided that nothing in this paragraph shall preclude an appeal being brought separately before the Court of Appeal in accordance with any law for the time being in force in Malta.

- EnglishCitizens individually or collectively shall be entitled to file a special petition for protection against judgments, final writs or resolutions that have the force of sentencing. For ruling on the admissibility of this appeal, the court shall check compliance with the following requirements:
1. That the judgments, writs and resolutions are final and fully enforceable.
2. That the complainant shows that, in the judgment, there has been a breach, either by deed or omission, of due process of law or other rights enshrined in the Constitution. 1°) compliance of the National Council’s rules of procedure with constitutional and, if need be, legislative provisions under the conditions prescribed by article 61;
2°) appeals on petitions for annulment, petitions to review validity and actions for damages arising from violations of these rights and freedoms prescribed in chapter III3 of the Constitution, and which are not referred to in subsection B of the present article.

If the Constitutional Council, referred [to the matter] by the President of the Republic, the President of the National Assembly or of the Senate or by one-tenth at least of the Deputies or of the Senators, has declared that an international treaty or agreement includes a clause contrary to the Constitution, the authorization to ratify it can take place only after revision of the Constitution. - English(1) An appeal to the Court of Appeal shall lie as of right from decisions of the High Court in the following cases, that is to say -
(a) final decisions in any civil or criminal proceedings on questions as to the interpretation of this Constitution; and
(b) final decisions given in exercise of the jurisdiction conferred on the High Court by article 153 (which relates to the enforcement of fundamental rights and freedoms).
(2) Nothing in paragraph (1) shall apply to the matters for which provision is made by article 163. (Art. 133)
