- EnglishThe Constitutional Council sees to and decides when it is referred to a matter:
• on the constitutionality of the laws before their promulgation;
• on the constitutionality of the internal regulations of the Senate and of the Chamber of Deputies before their implementation
• on the orders
For the same purposes, the laws in general may be referred to the Constitutional Council, before their promulgation, by the President of the Republic, the President of the Senate, the President of the Chamber of Deputies, a group of fifteen (15) Deputes or of (10) Senators.
The law determines the modalities of organization and of functioning of the Constitutional Council as well as the other entities enabled to refer a matter to it. (Art. 190ter-5) - FrenchLe Conseil Constitutionnel veille et statue lorsqu'il est saisi:
a. sur la constitutionnalité des lois organiques avant leur promulgation;
b. sur la constitutionnalité des règlements intérieurs du Sénat et de la Chambre des Députés avant leur mise en application.

Aux mêmes fins, les lois en général peuvent être déférées au Conseil constitutionnel, avant leur promulgation, par le Président de la République, le Président du Sénat, le Président de la Chambre des Députés, un groupe de quinze (15) députés ou de dix Sénateurs.

- EnglishThe President of the Republic, the two political party groups having the largest number of members in the Grand National Assembly of Turkey, and at least one-fifth of the total number of members of the Grand National Assembly of Turkey shall have the right to apply for annulment action directly to the Constitutional Court, based on the assertion of the unconstitutionality, in form and in substance, of laws, of presidential decrees, of Rules of Procedure of the Grand National Assembly of Turkey or of certain articles or provisions thereof. - English1. Anyone who considers that a provision of the Constitution has been infringed in relation to him may, without prejudice to any other legal remedy available to him, apply to the Supreme Court for redress.
2. The Supreme Court has jurisdiction to determine the matter and to make such order as it considers appropriate to enforce the provisions of the Constitution.
3. When a question concerning the interpretation of the Constitution arises before a subordinate court, and the court considers that the question concerns a fundamental point of law, the court shall submit the question to the Supreme Court for its determination. (Art. 53) - French1) Quiconque estime qu'une disposition de la Constitution a été violée à son encontre peut, sans préjudice des autres recours légaux ouverts, saisir la Cour Suprême pour dénoncer cette violation et obtenir réparation.
2) La Cour Suprême a compétence pour déterminer si une disposition de la Constitution a été violée et pour faire une déclaration en conséquence.
3) Lorsqu'une question relative à l'interprétation de la Constitution est soulevée devant une juridiction inférieure et que celle-ci considère que la question a trait à un point de droit fondamental, cette juridiction doit, à titre préjudiciel, soumettre cette question à la Cour Suprême. (Art. 53)

- EnglishThe organic laws, before their promulgation and the regulations of the National Assembly before their implementation [mise en application], must be submitted to the Constitutional Council which decides concerning their conformity with the Constitution.
To the same ends, the laws can be referred [déférées] to the Constitutional Council, before their promulgation, by the President of the Republic, the President of the National Assembly, or by one-third (1/3) of the Deputies composing the National Assembly.

Le Conseil Constitutionnel est compétent pour connaitre d’une exception d’inconstitutionnalité soulevée au cours d’un procès, lorsqu’il est soutenu par l’une des parties que la loi dont dépend l’issue du litige, porte atteinte aux droits et libertés garantis par la constitution. (Art. 86)

- EnglishWhen the Executive Authority vetoes a bill as unconstitutional and the National Assembly by majority vote insists that it be adopted, the bill shall be sent to the Supreme Court for a decision on its constitutionality. If the Supreme Court's judgment declares the bill constitutional, the Executive Authority is obliged to approve it and have it promulgated. (Art. 171)
- SpanishCuando el Ejecutivo objetare un proyecto por inexequible y la Asamblea Nacional, por la mayoría expresada, insistiere en su adopción, aquél lo pasará a la Corte Suprema de Justicia para que decida sobre su inconstitucionalidad. El fallo de la Corte que declare el proyecto constitucional, obliga al Ejecutivo a sancionarlo y hacerlo promulgar. (Art. 171)

- English1. Appeals of unconstitutionality against laws or statutory rules may be lodged by one fifth of the General Council, the Head of Government and three Local Councils. One fifth of the General Council may lodge an appeal of unconstitutionality against the Rules of Procedure of the Chamber. The Constitutional Court pronounces whether state treaties are unlawful. Art. 140 shall apply to political, to law-modifying and to law-amending state treaties and to state treaties modifying the Treaty basis of the European Union, Art. 139 to all other state treaties with the following proviso,

- decides, in the case of dispute on the regularity of the legislative elections;

- English1. There shall be a Constitutional Court which is an independent body composed of a President, Vice-President and three members, who -as well as the three deputy members -shall be appointed for a period of five years at the recommendation of the National Assembly.
2. The tasks of the Constitutional Court shall be:
a. to verify the purport of Acts or parts thereof against the Constitution, and against applicable agreements concluded with other states and with international organization;
b. to assess the consistency of decisions of government institutions with one or more of the constitutional rights mentioned in Chapter V3.
