- English(1) The following are entitled to:
a) Lodge an appeal of unconstitutionality: the President of the Government, the Defender of the People, fifty Members of Congress, fifty Senators, the Executive body of a Autonomous Community and, where applicable, its Assembly.
b) Lodge an individual appeal for protection (recurso de amparo): any individual or body corporate with a legitimate interest, as well as the Defender of the People and the Public Prosecutor's Office.
(2) In all other cases, the organic act shall determine which persons and bodies shall have right of appeal to the Court. (Sec. 162) - Spanish1. Están legitimados:
a) Para interponer el recurso de inconstitucionalidad, el Presidente del Gobierno, el Defensor del Pueblo, 50 Diputados, 50 Senadores, los órganos colegiados ejecutivos de las Comunidades Autónomas y, en su caso, las Asambleas de las mismas.
b) Para interponer el recurso de amparo, toda persona natural o jurídica que invoque un interés legítimo, así como el Defensor del Pueblo y el Ministerio Fiscal.

The following recourses and mechanisms of constitutional control are also established:
1) The Recourse of Habeas Data as guarantee of protection [tutela] of personal data established [asentados] in archives, registers, databases or other technical means, of public or private nature, whose publicity constitutes [an] invasion of personal privacy and has relevance to the treatment of sensitive data of the persons in their intimate and familiar domain [ámbito]. The Recourse of Habeas Data proceeds in favor of any person to know in what circumstances, to what ends, when, and who makes contact with their personal data and its improper [indebida] publicity.
2) The conflict of competence and constitutionality between the Powers of the State. The representatives of the Powers of the State will promote the conflict of competence and constitutionality when they consider that a law, decree or regulation, act, resolution or provision of another organ [órgano], invades the domain of their privative constitutional competences.
3) The control of constitutionality in [a] concrete case as incidental mechanism of control. When in a case submitted to the cognizance of [a] judicial authority, it considers that a norm on whose validity the decision [fallo] depends is contrary to the Constitution, it must proceed to declare its unconstitutionality for that specific [en concreto] case. The parties in the process may solicit the unconstitutionality of a norm that is being applied to the case. The judicial authority must pronounce itself on the point, accepting [acogiendo] or rejecting the claim [pretensión].
4) The conflicts of constitutionality between the Central Government and the Municipal Governments and [Governments] of the Autonomous Regions of the Caribbean Coast.

Se establecen también los siguientes recursos y mecanismos de control constitucional:
1) El Recurso de Habeas Data como garantía de tutela de datos personales asentados en archivos, registros, bancos de datos u otros medios técnicos, de naturaleza pública o privada, cuya publicidad constituya invasión a la privacidad personal y tenga relevancia con el tratamiento de datos sensibles de las personas en su ámbito íntimo y familiar. El Recurso de Habeas Data procede a favor de toda persona para saber quién, cuándo, con qué fines y en qué circunstancias toma contacto con sus datos personales y su publicidad indebida.
2) El conflicto de competencia y constitucionalidad entre los Poderes del Estado. Los representantes de los Poderes del Estado promoverán el conflicto de competencia y constitucionalidad cuando consideren que una ley, decreto o reglamento, acto, resolución o disposición de otro órgano, invade el ámbito de sus competencias privativas constitucionales.
3) El control de constitucionalidad en caso concreto como un mecanismo incidental de control. Cuando en un caso sometido al conocimiento de autoridad judicial, ésta considere que una norma de cuya validez depende el fallo es contraria a la Constitución, deberá proceder a declarar su inconstitucionalidad para el caso en concreto. Las partes en el proceso pueden solicitar la inconstitucionalidad de una norma que se esté aplicando al caso. La autoridad judicial deberá pronunciarse sobre el punto, acogiendo o rechazando la pretensión.
4) Los conflictos de constitucionalidad entre el Gobierno Central y los Gobiernos Municipales y de las Regiones Autónomas de la Costa Caribe.
La Ley de Justicia Constitucional regulará los recursos y mecanismos establecidos en este capítulo. (Art. 190)

It is charged with deciding on the constitutionality of the laws, of the ordinances as well as of the conformity of international treaties and agreements with the Constitution.
It interprets the provisions of the Constitution. It controls the regularity, the transparency and the honesty [sincérité] of the referendum, [and] of the presidential and legislative elections. It is [the] judge of the electoral disputes [contentieux] and proclaims the definitive results of the elections. 3. The Beretitenti may withhold his assent to a Bill only if he is of the opinion that the Bill, if assented to, would be inconsistent with this Constitution.
4. If the Beretitenti withholds his assents to a Bill under the preceding subsection, the Bill shall be returned to the Maneaba for amendment.
5. If a Bill which has been returned to the Maneaba under the preceding subsection is again presented to the Beretitent, and the Beretitenti is still of the opinion that the Bill, if assented to, would be inconsistent with this Constitution, the Beretitenti shall refer the Bill to the High Court for a declaration as to whether or not the Bill, if assented to, would be inconsistent with this Constitution.
6. If the High Court declares that the Bill, if assented to, would not be inconsistent with this Constitution, the Beretitenti shall assent to the Bill forthwith; if the High Court declares otherwise, the Bill shall be returned to the Maneaba.

- English(1) The High Court shall have jurisdiction to supervise any civil or criminal proceedings before any subordinate court and may make such orders, issue such writs and give such directions as it may consider appropriate for the purpose of ensuring that justice is duly administered by any such court.
(2) Where any question as to the interpretation of any provision of this Constitution other than Chapter II arises in any subordinate court and the court is of opinion that the question involves a substantial question of law, the court shall refer the question to the High Court.
(3) Where any question is referred to the High Court in pursuance of the preceding subsection, the High Court shall give its decision upon the question and the court in which the question arose shall dispose of the case in accordance with that decision or, if that decision is the subject of an appeal to the Court of Appeal, in accordance with the decision of the Court of Appeal. - EnglishThe following are functions of the Constitutional Division of the Supreme Tribunal of Justice:
1. To declare the nullity, in whole or in part, of national laws and other acts of National Assembly with the force of law, which are in conflict with this Constitution.
2. To declare the nullity, in whole or in part, of state Constitutions and laws, municipal ordinances and other acts of the deliberating bodies of the States and Municipalities which are issued by way of direct and immediate implementation of the Constitution and are in conflict with the same.
3. To declare the nullity, in whole or in part, of acts of the National Executive with the force of law, which are in conflict with this Constitution.
4. To declare the nullity, in whole or in part, of acts issued by way of direct and immediate implementation of the Constitution by any other government organ exercising Public Power.
5. To verify, at the request of the President of the Republic or the National Assembly, the constitutionality of international treaties signed by the Republic, prior to ratification of the same.
6. To review in all cases, even ex officio, the constitutionality of decree of the President of the Republic decreeing states of exception.
7. To declare the unconstitutionality of omissions on the part of the municipal, state, national or legislatures, in failing to promulgate rules or measures essential to guaranteeing compliance with the Constitution, or promulgating it in an incomplete manner; and to establish the time limit and, where necessary, guidelines for correcting the deficiencies.
8. To resolve any conflicts existing between different provisions of law, and declare which of the same must prevail.
9. To resolve constitutional controversies arising between any of the organs of Public Power.
10. To review judgments embodying constitutional protective orders or control on the constitutionality of laws or juridical rules, handed down by the courts of the Republic, on the terms established by the pertinent organic law.
11. Any other functions established by this Constitution or by law. (Art. 336) - SpanishSon atribuciones de la Sala Constitucional del Tribunal Supremo de Justicia:
1. Declarar la nulidad total o parcial de las leyes nacionales y demás actos con rango de ley de los cuerpos legislativos nacionales que colidan con esta Constitución.

6. Revisar, en todo caso, aun de oficio, la constitucionalidad de los decretos que declaren estados de excepción dictados por el Presidente o Presidenta de la República.
7. Declarar la inconstitucionalidad de las omisiones del legislador o la legisladora nacional, estadal o municipal, cuando haya dejado de dictar las normas o medidas indispensables para garantizar el cumplimiento de la Constitución, o las haya dictado en forma incompleta, y establecer el plazo y, de ser necesario, los lineamientos de su corrección.
8. Resolver las colisiones que existan entre diversas disposiciones legales y declarar cuál de éstas debe prevalecer.
9. Dirimir las controversias constitucionales que se susciten entre cualesquiera de los órganos del Poder Público.
10. Revisar las sentencias de amparo constitucional y de control de constitucionalidad de leyes o normas jurídicas dictadas por los Tribunales de la República, en los términos establecidos por la ley orgánica.
11. Las demás que establezcan esta Constitución y la ley. (Art. 336)
