- EnglishThe Constitutional Court is the jurisdiction given the charge of seeing to respect for the provisions of the Constitution.
The Constitutional Court judges the regularity of the referendum consultations, [and] of the presidential, legislative and senatorial elections. It decides on the challenges to these consultations and elections.
It is the judge of the constitutionality of the laws.
The laws may, before their promulgation, be deferred to the Constitutional Court by the President of the Republic, the Prime Minister, the President of the National Assembly, the President of the Senate, the President of High Authority of Audiovisuals and of Communications [Haute Autorité de l'Audiovisuel et de la Communication], the President of the Economic and Social Council, the President of the National Commission of the Rights of Man, the President of the Superior Council of the Magistrature, the Mediator of the Republic, the presidents of the parliamentary groups or one-fifth (1/5) of the members of the National Assembly or of the Senate.
To the same ends, the organic laws, before their promulgation, the internal regulations of the National Assembly and of the Senate, those of the High Authority of Audiovisuals and of Communications, [those] of the Economic and Social Council [those] of the National Commission of the Rights of Man, [and those] of the Superior Council of the Magistrature must be submitted to it before their application.
The Constitutional Court may be referred to [the matter] of a demand for [its] opinion on the meaning of the constitutional provisions by the President of the Republic, the Prime Minister, the President of the National Assembly, the President of the Senate, the President of High Authority of Audiovisuals and of Communications, the President of the Economic and Social Council, the President of the National Commission of the Rights of Man, the President of the Superior Council of the Magistrature, the Mediator of the Republic and the presidents of the parliamentary groups.
An organic law determines the other authorities and juridical [morale] persons who can refer the Constitutional Court [to matters], in matters of protection of fundamental rights.
In the course of a judicial instance, any physical or juridical person may, in limine litis, before the courts and tribunals, raise the pleadings [exception] of the unconstitutionality of a law. (1) Any citizen of Nepal may file a petition in the Supreme Court to have any law or any part thereof declared void on the ground of inconsistency with this Constitution because it imposes unreasonable restriction on the enjoyment of any fundamental right conferred by this Constitution or on any other ground; or to have any law or any part thereof made by a Provincial Assembly declared void because it is inconsistent with any law made by the Federal Parliament; or to have any law or any part thereof made by a Municipal Assembly or Rural Municipal Assembly declared void because it is inconsistent with a law made by the Federal Parliament or the Provincial Assembly; the Supreme Court shall have an extra-ordinary power to declare such law to be void either ab initio or from the date of its decision in case the law in question appears to be so inconsistent.
(2) The Supreme Court shall, for the enforcement of the fundamental rights conferred by this Constitution or of any other legal right for which no other remedy has been provided for or for which the remedy even though provided appears to be inadequate or ineffective or for the settlement of any constitutional or legal question involved in any dispute of public interest or concern; have the extraordinary power to issue necessary and appropriate orders, provide appropriate remedies, enforce such right or settle such dispute.

(4) Subject to this Constitution, the Supreme Court shall, as provided for in the federal law, have the power to originally try and settle cases, hear appeals, test judgments referred for confirmation, revise cases, hear petitions or review its judgments or final orders. While so reviewing the judgements, Justices other than those having handed down the previous judgment shall make such review.
(5) The Supreme Court shall have the power to settle appeals from cases originally heard and settled by a High Court and matters of public importance involving questions of interpretation of the Constitution and law or cases recommended by a High Court, accompanied by its opinion that it is reasonable that decision be made by the Supreme Court.
(6) Other powers and procedures of the Supreme Court shall be as provided for in the federal law. (Art. 133) - Nepali

(a) judgment, decision, declaration or advisory opinion of the European Court of Human Rights,
(b)opinion of the Commission given in a report adopted under Article 31 of the Convention,
(c)decision of the Commission in connection with Article 26 or 27(2) of the Convention, or
(d)decision of the Committee of Ministers taken under Article 46 of the Convention,whenever made or given, so far as, in the opinion of the court or tribunal, it is relevant to the proceedings in which that question has arisen.
(2) Evidence of any judgment, decision, declaration or opinion of which account may have to be taken under this section is to be given in proceedings before any court or tribunal in such manner as may be provided by rules.

(1) Subject to the provisions of sections 33(2), 34(4), 54(18), 69(6), 80(4) and 123(3) of this Constitution, where any question as to the interpretation of this Constitution or the interpretation or application of the Treaty (as defined in section 131 of this Constitution) arises in any court of law established for Belize (other than the High Court or the Court of Appeal), and the court is of the opinion that the question involves a substantial question of law, the court shall refer the question to the High Court.
(2) Where any question is referred to the High Court in pursuance of this section, the High Court shall, subject to subsection (3) below, give its decision upon the question and the court in which the question arose shall dispose of the case in accordance with that decision or, if the decision is the subject of an appeal to the Court of Appeal or the Caribbean Court of Justice, in accordance with the decision of the Court of Appeal or, as the case may be, the Caribbean Court of Justice.

(1) The Supreme Court shall, to the exclusion of any other court, have original jurisdiction to determine any question arising under or involving the interpretation or effect of any provision of this Constitution.
(2) Without prejudice to any appellate jurisdiction of the Supreme Court, where in any proceedings before another court a question arises involving the interpretation or effect of any provision of this Constitution, the cause shall be removed into the Supreme Court, which shall determine that question and either dispose of the case or remit it to that other court to be disposed of in accordance with the determination. - EnglishThe Constitutional Court takes cognizance of the recourses for interpretation of the Constitution on being referred to [the matter] by the President of the Republic, by the Government, by the President of the Senate, by the President of the National Assembly, by one-tenth of the members of each of the parliamentary Chambers, by the provincial Governors and by the Presidents of the Provincial Assemblies.
It resolves disputes concerning the presidential and legislative elections as well [concerning the] referendum.
It takes cognizance of the conflicts of competence between the Executive Power and the Legislative Power as well as between the State and the Provinces.
It takes cognizance of the recourses against the orders rendered by the Court of Cassation and the Council of State, only insofar as it decides on the attribution of the litigation to the jurisdiction of the judicial order or [to the] administrative [order]. This recourse is only receivable if a denial of jurisdiction has been raised by or before the Court of Cassation or the Council of State.
The modalities and the effects of the recourses referred to in the preceding paragraphs are determined by the law. If the President applies to the Constitutional Court with a proposal to verify the constitutionality of a law within the specified period, the deadline for signing such a law shall be suspended while the proposal is being examined by the Constitutional Court. The opinion of the Constitutional Court must be adopted no later than ten days from the date of submission of the proposal by the President. If the Constitutional Court confirms the constitutionality of a law, the President shall sign it within five days of the adoption of the opinion by the Constitutional Court. If the Constitutional Court finds a law to be unconstitutional, the President shall return it to the House of Representatives.
If the President does not return a law within two weeks of its submission to the President or, if the Constitutional Court has issued an opinion on the constitutionality of a law, within five days of the adoption of the opinion, the law is considered signed. A law is not considered signed and does not enter into force if it could not be returned to Parliament at the end of the session.

Если Президент в течение указанного срока обратится в Конституционный Суд с предложением о проверке конституционности закона, срок для подписания такого закона приостанавливается на время рассмотрения предложения Конституционным Судом. Заключение Конституционного Суда должно быть принято не позднее десяти дней со дня внесения Президентом соответствующего предложения. Если Конституционный Суд подтвердит конституционность закона, Президент подписывает его в пятидневный срок со дня принятия Конституционным Судом соответствующего заключения. В случае признания Конституционным Судом закона не соответствующим Конституции Президент возвращает его в Палату представителей.
Если Президент не возвращает какой-либо закон на протяжении двух недель после того, как он был представлен Президенту, а в случае принятия Конституционным Судом заключения о конституционности закона – пяти дней со дня принятия соответствующего заключения, закон считается подписанным. Закон не считается подписанным и не вступает в силу, если он не мог быть возвращен в Парламент в связи с окончанием сессии.
