(1) The President may refer to a tribunal consisting of not less than 3 Supreme Court Judges for its opinion any question as to the effect of any provision of this Constitution which has arisen or appears to him likely to arise.

(1) Subject to the provisions of sections 33(2), 34(4), 54(18), 69(6), 80(4) and 123(3) of this Constitution, where any question as to the interpretation of this Constitution or the interpretation or application of the Treaty (as defined in section 131 of this Constitution) arises in any court of law established for Belize (other than the High Court or the Court of Appeal), and the court is of the opinion that the question involves a substantial question of law, the court shall refer the question to the High Court.
(2) Where any question is referred to the High Court in pursuance of this section, the High Court shall, subject to subsection (3) below, give its decision upon the question and the court in which the question arose shall dispose of the case in accordance with that decision or, if the decision is the subject of an appeal to the Court of Appeal or the Caribbean Court of Justice, in accordance with the decision of the Court of Appeal or, as the case may be, the Caribbean Court of Justice.

The High Court shall have jurisdiction, in any application made by any person under the preceding subsection or in any other proceedings lawfully brought before the Court, to determine whether any provision of this Constitution (other than Chapter II) has been contravened and to make a declaration accordingly:...
3. Where the High Court makes a declaration under the preceding subsection that any provision of this Constitution has been contravened and the person by whom the application under subsection (1) of this section was made or, in the case of other proceedings before the Court, the party in those proceedings in respect of whom the declaration is made, seeks relief, the High Court may grant to that person such remedy, being a remedy available against any person in any proceedings in the High Court under any law in force in Kiribati, as the Court considers appropriate.

5. The High Court shall have jurisdiction to make a declaration as to whether any Bill referred to it by the Beretitenti under section 66(5) of this Constitution, if assented to, would be inconsistent with this Constitution.
6. Subject to the provisions of this Constitution, the High Court shall have original jurisdiction to hear and determine any question as to the interpretation of this Constitution:Provided that the following authorities only are entitled to make application to the High Court under this subsection—
a. the Beretitenti, acting in accordance with the advice of the Cabinet;
b. the Attorney-General; and

- EnglishThe Constitutional Court takes cognizance of the recourses for interpretation of the Constitution on being referred to [the matter] by the President of the Republic, by the Government, by the President of the Senate, by the President of the National Assembly, by one-tenth of the members of each of the parliamentary Chambers, by the provincial Governors and by the Presidents of the Provincial Assemblies.
It resolves disputes concerning the presidential and legislative elections as well [concerning the] referendum.
It takes cognizance of the conflicts of competence between the Executive Power and the Legislative Power as well as between the State and the Provinces.
It takes cognizance of the recourses against the orders rendered by the Court of Cassation and the Council of State, only insofar as it decides on the attribution of the litigation to the jurisdiction of the judicial order or [to the] administrative [order]. This recourse is only receivable if a denial of jurisdiction has been raised by or before the Court of Cassation or the Council of State.
The modalities and the effects of the recourses referred to in the preceding paragraphs are determined by the law. (b) Part II, Division 5 (Enforcement of the Bill of Rights); and
(c) section 134 (constitutional interpretation), and otherwise by law. (Sec. 5)

The Constitutional Court decides obligatorily on:
– the treaties and international agreements before their entry into force, concerning their conformity with the Constitution, after the adoption by the Parliament of the law of authorization;
– the constitutionality of the organic laws and of the laws before their promulgation, of the ordinances as well as the regulatory acts [that] supposedly infringe the fundamental rights of the human person and the public freedoms, after their publication;
– the regulations of the National Assembly and of the Senate, the regulations of procedure of the Constitutional Court and the regulations of the Economic, Social and environmental Council, before their implementation, concerning their conformity with the Constitution;
– the regulations of the independent administrative authorities determined by the law, before their implementation, concerning their conformity with the Constitution;
– the conflicts of attribution between the institutions of the State;
– the regularity of the presidential [and] parliamentary elections, and of the operations of the referendum of which it proclaims the results.
The Constitutional Court is referred to [the matter] in case of dispute concerning the validity of an election, by any elector, any candidate, any political party or delegate of the Government under the conditions provided for by the organic law on the Constitutional Court. (Art. 84) - French
La Cour Constitutionnelle statue obligatoirement sur :
-les traités et accords internationaux avant leur entrée en vigueur, quant à leur conformité à la Constitution, après adoption par le Parlement de la loi d'autorisation ;
-la constitutionnalité des lois organiques et des lois avant leur promulgation, des ordonnances ainsi que des actes réglementaires censés porter atteinte aux droits fondamentaux de la personne humaine et aux libertés publiques, après leur publication ;

La Cour Constitutionnelle est saisie, en cas de contestation sur la validité d'une élection, par tout électeur, tout candidat, tout parti politique ou délégué du Gouvernement dans les conditions prévues par la loi organique sur la Cour Constitutionnelle. (Art. 84)

- EnglishThe Constitutional Court is the supreme body for controlling, constitutionally interpreting and administering justice in this matter. It exercises national jurisdiction and its seat is in the city of Quito.
The decisions related to the attributions provided for in the Constitution shall be adopted by the plenary of the Court.
