- EnglishThe Supreme Constitutional Court shall be solely competent to decide on the constitutionality of laws and regulations, to interpret legislative provisions, and to adjudicate on disputes pertaining to the affairs of its members, on jurisdictional disputes between judicial bodies and entities that have judicial jurisdiction, on disputes pertaining to the implementation of two final contradictory judgments, one of which is rendered by a judicial body or an authority with judicial jurisdiction and the other is rendered by another, and on disputes pertaining to the execution of its judgments and decisions.
The law shall determine the Court’s other competences and regulate the procedures that are to be followed before the Court. The President of the Republic may ask the Constitutional Court to conduct a prior review of the constitutionality of any rule contained in legislation that has been submitted for enactment, any international treaty submitted to him for ratification or any international agreement sent to him for signature.
2. One tenth of the Members of the National Assembly in full exercise of their office may also request a prior review of the constitutionality of any rule contained in legislation that has been submitted for enactment.

- English(1) The Supreme Court shall have an exclusive original jurisdiction—
(a) for the interpretation or enforcement of any provision of this Constitution other than any provision of sections 18 to 33 or section 36(5) (which relate to fundamental rights and freedoms);
(b) on any question whether any law was made in excess of the powers conferred by this Constitution or any other law upon the National Assembly or any other person or authority;
(c) on any question as to whether or not any person was validly elected to the office of President or was validly elected to, or vacated his or her seat in, the National Assembly;
(d) on any question whether any official document should be produced, or its contents disclosed, in proceedings before a court where such production is resisted on the grounds that its production or the disclosure of its contents would be prejudicial to the security of the State or be injurious to the public interest.
(2) Where any question referred to in paragraphs (a), (b) or (d) of subsection (1) arises in any proceedings in any other court, that court shall stay its proceedings and refer the matter to the Supreme Court for its determination, and such other court shall give effect to any decision of the Supreme Court in the matter.

The Constitutional Council is referred to [a matter] by:
• the President of Faso;
• the Prime Minister;
• the President of the National Assembly;
• one-tenth (1/10) at least of the members of the National Assembly.
In addition, any citizen may refer [a matter] to the Constitutional Council concerning the constitutionality of the laws, either directly, or through the procedure of the pleadings [exception] of unconstitutionality invoked in a matter [affaire] which concerns them before a jurisdiction. This must postpone [the matter] until the decision of the Constitutional Council which must intervene within a maximum period of time of thirty days counting from its referral [to the matter].
The Constitutional Council can refer itself to any questions relative to its competence, if it judges it necessary. (Art. 157) - French
Le Conseil constitutionnel est saisi par :
• le Président du Faso;
• le Premier ministre;
• le Président de l'Assemblée nationale;
• un dixième (1/10) au moins des membres de chaque chambre du Parlement.
En outre, tout citoyen peut saisir le Conseil constitutionnel sur la constitutionnalité des lois, soit directement, soit par la procédure de l’exception d’inconstitutionnalité invoquée dans une affaire qui le concerne devant une juridiction. Celle-ci doit surseoir jusqu’à la décision du Conseil constitutionnel qui doit intervenir dans un délai maximum de trente jours à compter de sa saisine.
Le Conseil constitutionnel peut se saisir de toutes questions relevant de sa compétence s’il le juge nécessaire. (Art. 157)

- EnglishWhere any person or any association alleges that any of the rights granted under this Constitution or any legislation or directives are constitutionally contravened, that person or association may invoke the privilege and benefit of court direction, order or writ, including a judgment of unconstitutionality; and anyone injured by an act of the Government or any person acting under its authority, whether in property, contract, tort or otherwise, shall have the right to bring suit for appropriate redress. All such suits brought against the Government shall originate in a Claims Court; appeals from judgment of the Claims Court shall lie directly to the Supreme Court. (Art. 26)

- English(1) The Constitutional Council shall give a final ruling on:
- the constitutionality of laws, treaties and international agreements;
- the constitutionality of the standing orders of the National Assembly and the Senate prior to their implementation;
- conflict of powers between State institutions; between the State and the Regions, and between the Regions.
(2) Matters may be referred to the Constitutional Council by the President of the Republic, the President of the National Assembly, the President of the Senate, one-third of the members of the National Assembly or one-third of the Senators.
Presidents of regional executives may refer matters to the Constitutional Council whenever the interests of their Regions are at stake.
(3) Laws as well as treaties and international agreements may, prior to their enactment, be referred to the Constitutional Council by the President of the Republic, the President of the National Assembly, the President of the Senate, one-third of the members of the National Assembly, one third of the Senators, or the Presidents of the regional executives pursuant to the provisions of paragraph (2) above.

(4) The Constitutional Council shall advice in matters falling under its jurisdiction. (Art. 47) - French(1) Le Conseil Constitutionnel statue souverainement sur :
- La constitutionnalité des lois, des traités et accords internationaux ;
- les règlements intérieurs de lʼAssemblée Nationale et du Sénat, avant leur mise en application, quant à leur conformité à la Constitution ;

(2) Le Conseil Constitutionnel est saisi par le Président de la République, le président de lʼAssemblée Nationale, le président du Sénat, un tiers des députés ou un tiers des sénateurs.
Les présidents des exécutifs des régionaux peuvent saisir le Conseil Constitutionnel lorsque les intérêts de leur région sont en cause.
(3) Avant leur promulgation, les lois ainsi que les traités et accords internationaux peuvent être déférés au Conseil Constitutionnel par le Président de la République, le président de lʼAssemblée Nationale, le président du Sénat, un tiers des députés ou un tiers des sénateurs, les présidents des exécutifs régionaux conformément aux dispositions de lʼalinéa 2 ci-dessus.
