- EnglishThe declaration of unconstitutionality of a law and its abrogation [derogación], may be solicited, by anyone who considers himself injured in his direct, personal, and legitimate interest:
1) By way of action that must be brought [entablar] before the Supreme Court of Justice;
2) By way of exception. which may be opposed in any judicial proceeding; and
3) Also[,] the Jurisdictional Organ that takes cognizance in any Judicial proceeding may solicit[,] of office[,] the declaration of unconstitutionality of a Law and its abrogation before dictating a decision [resolución].
In the cases contemplated in numerals 2) and 3), the activity [actuaciones] must be elevated to the Supreme Court of Justice[,] the procedure following from the moment of summons for decision [sentencia], after which the judicial procedure of the partial question in the sphere of the resolution concerning the unconstitutionality must be suspended. 1. The Constitutional court shall examine and settle constitutional disputes on its own initiative on the basis of petitions and information received from citizens or at the request of the State Great Khural, the President, the Prime Minister, the Supreme Court and the Prosecutor General.
2. The Constitutional court in accordance with Paragraph 1 of this Article shall make and submit conclusion to the State Great Khural on the following issues under a dispute:
1/ whether laws, decrees and other decisions of the State Great Khural and the President, as well as Government decisions and international treaties to which Mongolia is a party are in conformity with the Constitution or not;

3/ whether the President, Speaker and members of the State Great Khural, the Prime Minister, members of the Government, the Chief Justice of the Supreme court, and the Prosecutor General breached the law or not;

- English(1) The following are entitled to:
a) Lodge an appeal of unconstitutionality: the President of the Government, the Defender of the People, fifty Members of Congress, fifty Senators, the Executive body of a Autonomous Community and, where applicable, its Assembly.
b) Lodge an individual appeal for protection (recurso de amparo): any individual or body corporate with a legitimate interest, as well as the Defender of the People and the Public Prosecutor's Office.
(2) In all other cases, the organic act shall determine which persons and bodies shall have right of appeal to the Court. (Sec. 162) - Spanish1. Están legitimados:
a) Para interponer el recurso de inconstitucionalidad, el Presidente del Gobierno, el Defensor del Pueblo, 50 Diputados, 50 Senadores, los órganos colegiados ejecutivos de las Comunidades Autónomas y, en su caso, las Asambleas de las mismas.
b) Para interponer el recurso de amparo, toda persona natural o jurídica que invoque un interés legítimo, así como el Defensor del Pueblo y el Ministerio Fiscal.

1. Subject to sections 41(5), 64(5) and 101(1)4, where any person alleges that any provision of this Constitution (other than Chapter II) has been contravened and that his interests are being or are likely to be affected by such contravention, then, without prejudice to any other action with respect to the same matter which is lawfully available, that person may apply to the Supreme Court for a declaration and for relief under this section.
2. The Supreme Court shall have jurisdiction, in any application made by any person in pursuance of subsection (1) or in any other proceedings lawfully brought before the court, to determine whether any provision of this Constitution (other than Chapter II) has been contravened and to make a declaration accordingly:
Provided that the Supreme Court shall, not make a declaration in pursuance of the jurisdiction conferred by this subsection unless it is satisfied that the interests of the person by whom the application under subsection (1) is made or, in the case of other proceedings before the court, a party to these proceedings, are being or are likely to be affected.
3. Where the Supreme Court makes a declaration in pursuance of subsection (2) that any provision of the Constitution has been contravened and the person by whom the application under subsection (1) was made or, in the case of other proceedings before the court, the party in those proceedings in respect of whom declaration is made, seeks relief, the Supreme Court may grant to that person such remedy, being a remedy available against any person in any proceedings in the Supreme Court under any law for the time being in force in Mauritius, as the court considers appropriate.
4. The Chief Justice may make rules with respect to the practice and procedure of the Supreme Court in relation to the jurisdiction and powers conferred on it by this section (including rules with respect to the time within which applications shall be made under subsection (1)).
5. Nothing in this section shall confer jurisdiction on the Supreme Court to hear or determine any such question as is referred to in section 375 or paragraph 2(5), 3(2) or 4(4) of the First Schedule otherwise than upon an application made in accordance with that section or that paragraph, as the case may be. 3. The Beretitenti may withhold his assent to a Bill only if he is of the opinion that the Bill, if assented to, would be inconsistent with this Constitution.
4. If the Beretitenti withholds his assents to a Bill under the preceding subsection, the Bill shall be returned to the Maneaba for amendment.
5. If a Bill which has been returned to the Maneaba under the preceding subsection is again presented to the Beretitent, and the Beretitenti is still of the opinion that the Bill, if assented to, would be inconsistent with this Constitution, the Beretitenti shall refer the Bill to the High Court for a declaration as to whether or not the Bill, if assented to, would be inconsistent with this Constitution.
6. If the High Court declares that the Bill, if assented to, would not be inconsistent with this Constitution, the Beretitenti shall assent to the Bill forthwith; if the High Court declares otherwise, the Bill shall be returned to the Maneaba.
