- English(1) There shall be an Ombudsman, who shall have the powers and functions set out in this Constitution.
(2) The Ombudsman shall be independent and subject only to this Constitution and the law.
(3) No member of the Cabinet or the Legislature or any other person shall interfere with the Ombudsman in the exercise of his or her functions and all organs of the State shall accord such assistance as may be needed for the protection of the independence, dignity and effectiveness of the Ombudsman.

- EnglishThe functions of the Commission shall be defined and prescribed by Act of Parliament and shall include the duty—
(a) to investigate complaints of violations of fundamental rights and freedoms, injustice, corruption, abuse of power and unfair treatment of any person by a public officer in the exercise of his official duties;
(b) to investigate complaints concerning the functioning of the Public Services Commission, the administrative organs of the State, the Armed Forces, the Police Service and the Prisons Service in so far as complaints relate to the failure to achieve a balanced structuring of those services or equal access by all to the recruitment of those services or fair administration in relation to those services;
(c) to investigate complaints concerning practices and actions by persons, private enterprises and other institutions where those complaints allege violations of fundamental rights and freedoms under this Constitution;
(d) to take appropriate action to call for the remedying, correction and reversal of instances specified in paragraphs (a), (b) and (c) of this clause through such means as are fair, proper and effective,

(f) to educate the public as to human rights and freedoms by such means as the Commissioner may decide, including publications, lectures and symposia; and
(g) to report annually to Parliament on the performance of its functions. (Art. 218)

The Defender of the People is elected and removed by the Congress with the vote of two-thirds of its legal number. He enjoys the same immunity and the same prerogatives as the Congressmen.
To be elected Defender of the People, it is required to have attained 35 years of age and to be an attorney.

El Defensor del Pueblo es elegido y removido por el Congreso con el voto de los dos tercios de su número legal. Goza de la misma inmunidad y de las mismas prerrogativas de los congresistas.
Para ser elegido Defensor del Pueblo se requiere haber cumplido treinta y cinco años de edad y ser abogado.
El cargo dura cinco años y no está sujeto a mandato imperativo. Tiene las mismas incompatibilidades que los vocales supremos. (Art. 161)

- English(1) The Advocate of the People shall be appointed for a term of office of 5 years, in order to defend the natural persons' rights and freedoms. The Advocate of the People's deputies shall be specialized per fields of activity.
(2) The Advocate of the People and his/her deputies shall not perform any other public or private office, except for teaching positions in higher education.
(3) The organization and functioning of the Advocate of the People institution shall be regulated by an organic law. The Public Defender (Defensor del Pueblo) shall oversee the enforcement, promotion, dissemination of and compliance with human rights, both individual and collective, that are established in the Constitution, laws and international instruments. The function of the Public Defender shall extend to the administrative activity of the entire public sector and the activity of private institutions that provide public services.
II. The Public Defender shall also promote the defense of the rights of the nations and rural native indigenous peoples, of urban and intercultural communities, and of Bolivians who are abroad.
III. The Public Defender is an institution with operational, financial and administrative autonomy, in accordance with the law. Its functions shall be governed by the principles of free services, accessibility, swiftness and solidarity. In the exercise of its functions it does not receive instructions from the organs of the State. (Art. 218) - SpanishI. La Defensoría del Pueblo velará por la vigencia, promoción, difusión y cumplimiento de los derechos humanos, individuales y colectivos, que se establecen en la Constitución, las leyes y los instrumentos internacionales. La función de la Defensoría alcanzará a la actividad administrativa de todo el sector público y a la actividad de las instituciones privadas que presten servicios públicos.
II. Corresponderá asimismo a la Defensoría del Pueblo la promoción de la defensa de los derechos de las naciones y pueblos indígena originario campesinos, de las comunidades urbanas e interculturales, y de las bolivianas y los bolivianos en el exterior.
III. La Defensoría del Pueblo es una institución con autonomía funcional, financiera y administrativa, en el marco de la ley. - EnglishEveryone shall have the right to receive the support of the Human Rights Defender, in case of violation of his rights and freedoms enshrined in the Constitution and laws by state and local self-government bodies and officials or, in cases provided by the Law on the Human Rights Defender, by organizations. National human rights institutions shall supplement the existing forms and means of protecting human rights and freedoms, promote the development of civil society and enhance the culture of human rights.
