Obligations of the State
- English(1) The Bill of Rights is an integral part of Kenya’s democratic state and is the framework for social, economic and cultural policies.
(2) The purpose of recognising and protecting human rights and fundamental freedoms is to preserve the dignity of individuals and communities and to promote social justice and the realisation of the potential of all human beings.
(3) The rights and fundamental freedoms in the Bill of Rights—
(a) belong to each individual and are not granted by the State;
(b) do not exclude other rights and fundamental freedoms not in the Bill of Rights, but recognised or conferred by law, except to the extent that they are inconsistent with this Chapter; and
(c) are subject only to the limitations contemplated in this Constitution. (Art. 19) - Swahili(1) Sheria ya Haki za Binadamu ni sehemu muhimu ya serikali ya kidemokrasia ya Kenya na ni mwongozo wa sera za kijamii, kiuchumi na kiutamaduni.
(2) Madhumuni ya kutambua na kulinda haki za binadamu na uhuru wa msingi ni kulinda utu wa watu na jamii na kukuza haki ya kijamii na kuthamini umuhimu wa binadamu wote.
(3) Haki na uhuru wa msingi katika Sheria ya Haki za Binadamu-
(a) ni ya kila mtu na haitolewi na Serikali;
(b) haiondoi haki nyinginezo na uhuru wa msingi ambao haupo kwenye Sheria ya Haki za Binadamu, lakini hutambuliwa au hutolewa na sheria, isipokuwa kwa kiwango ambacho zipo kinyume cha Sura hii; na

- English(a) The enumeration of rights and freedoms in this Chapter are guaranteed equally to female and male persons.
(b) The enumeration of rights and freedoms individually in this Chapter shall not be construed to deny or negate other rights retained by the people which are not specified in this Chapter. - EnglishHuman and minority rights guaranteed by the Constitution shall be implemented directly.
The Constitution shall guarantee, and as such, directly implement human and minority rights guaranteed by the generally accepted rules of international law, ratified international treaties and laws. The law may prescribe manner of exercising these rights only if explicitly stipulated in the Constitution or necessary to exercise a specific right owing to its nature, whereby the law may not under any circumstances influence the substance of the relevant guaranteed right.
Provisions on human and minority rights shall be interpreted to the benefit of promoting values of a democratic society, pursuant to valid international standards in human and minority rights, as well as the practice of international institutions which supervise their implementation. Уставом се јемче, и као таква, непосредно се примењују људска и мањинска права зајемчена општеприхваћеним правилима међународног права, потврђеним међународним уговорима и законима. Законом се може прописати начин остваривања ових права само ако је то Уставом изричито предвиђено или ако је то неопходно за остварење појединог права због његове природе, при чему закон ни у ком случају не сме да утиче на суштину зајемченог права.

- English1. The human rights and freedoms enshrined in this Chapter3 shall be respected and upheld by the executive, legislature, judiciary and all organs of the Government and its agencies and, where applicable to them, by all natural and legal persons in Malawi and shall be enforceable in the manner prescribed in this Chapter.
2. Any person or group of persons, natural or legal, with sufficient interest in the promotion, protection and enforcement of rights under this Chapter shall be entitled to the assistance of the courts, the Ombudsman, the Human Rights Commission and other organs of the Government to ensure the promotion, protection and enforcement of those rights and the redress of any grievances in respect of those rights.
