Obligations of the State
- English1. The State shall recognize as inviolable the rights and liberties enshrined in the Constitution and shall guarantee their protection.
2. All public authorities shall have the duty to respect and to guarantee the free exercise of rights and liberties and the fulfillment of constitutional or legal duties. (Art. 15) - Portuguese1. O Estado reconhece como invioláveis os direitos e liberdades consignados na Constituição e garante a sua protecção.

- English1. Everyone shall have the right to claim compensation in accordance with the law, for damages caused by a violation of their fundamental rights.
2. The State shall be responsible for damages caused by the unlawful acts of its agents, in the performance of their functions, without prejudice to rights of recourse available under the law. - EnglishThe constitution guarantees the effectiveness of fundamental rights, through mechanisms of guardianship and protection, that offer to people the possibility of obtaining the fulfillment of their rights, when faced with those subjected, obligated, or owing to the same. Fundamental rights link all the public powers, which should guarantee their effectiveness in the terms established by the present Constitution and by the law. (Art. 68)
