- English(1) The existing aboriginal and treaty rights of the aboriginal peoples of Canada are hereby recognized and affirmed.
(2) In this Act, “aboriginal peoples of Canada” includes the Indian, Inuit and Métis peoples of Canada.
(3) For greater certainty, in subsection (1) “treaty rights” includes rights that now exist by way of land claims agreements or may be so acquired.
(4) Notwithstanding any other provision of this Act, the aboriginal and treaty rights referred to in subsection (1) are guaranteed equally to male and female persons. The Agrarian Reform will eliminate the idle latifundios [large estates] and will be made by priority with lands of the State. When the expropriation of idle latifundios affects private owners [proprietarios], it will be fulfilled within that stipulated in Article 44 of this Constitution. The Agrarian Reform shall eliminate any form of exploitation of the peasants, and of the indigenous communities of the country and shall promote forms of ownership compatible with the economic and social objectives of the Nation, established in this Constitution. The regime of ownership of the indigenous communities will be regulated in accordance with the law on the matter. (Art. 107)

La Reforma agraria eliminará el latifundio ocioso y se hará prioritariamente con tierras del Estado. Cuando la expropiación de latifundios ociosos afecte a propietarios privados se hará cumpliendo con lo estipulado en el artículo 44 de esta Constitución. La Reforma Agraria eliminará cualquier forma de explotación a los campesinos, a las comunidades indígenas del país y promoverá las formas de propiedad compatibles con los objetivos económicos y sociales de la nación, establecidos en esta Constitución. The Rural and the Native communities have legal existence and are juridical persons.
They are autonomous in their organization, in the communal work and in the use and free disposition of their lands, as well as in economic and administrative [matters], within the framework that the law establishes. The ownership of their lands is imprescriptible, except in the case of abandonment provided for in the preceding Article. The State respects the cultural identity of the Rural and Native Communities. Las Comunidades Campesinas y las Nativas tienen existencia legal y son personas jurídicas.
Son autónomas en su organización, en el trabajo comunal y en el uso y la libre disposición de sus tierras, así como en lo económico y administrativo, dentro del marco que la ley establece. La propiedad de sus tierras es imprescriptible, salvo en el caso de abandono previsto en el artículo anterior.
