Indians shall have their social organization, customs, languages, creeds and traditions recognized, as well as their original rights to the lands they traditionally occupy, it being incumbent upon the Union to demarcate them, protect and ensure respect for all of their property.
Paragraph 1. Lands traditionally occupied by Indians are those on which they live on a permanent basis, those used for their productive activities, those indispensable to the preservation of the environmental resources necessary for their well-being and for their physical and cultural reproduction, according to their uses, customs and traditions.
Paragraph 2. The lands traditionally occupied by Indians are intended for their permanent possession and they shall have the exclusive usufruct of the riches of the soil, the rivers and the lakes existing therein.
Paragraph 3. Hydric resources, including energetic potentials, may only be exploited, and mineral riches in Indian land may only be prospected and mined with the authorization of the National Congress, after hearing the communities involved, and the participation in the results of such mining shall be ensured to them, as set forth by law.
Paragraph 4. The lands referred to in this article are inalienable and indisposable and the rights thereto are not subject to limitation.
Paragraph 5. The removal of Indian groups from their lands is forbidden, except ad referendum of the National Congress, in case of a catastrophe or an epidemic which represents a risk to their population, or in the interest of the sovereignty of the country, after decision by the National Congress, it being guaranteed that, under any circumstances, the return shall be immediate as soon as the risk ceases.
Paragraph 6. Acts with a view to occupation, domain and possession of the lands referred to in this article or to the exploitation of the natural riches of the soil, rivers and lakes existing therein, are null and void, producing no legal effects, except in case of relevant public interest of the Union, as provided by a supplementary law and such nullity and voidness shall not create a right to indemnity or to sue the Union, except in what concerns improvements derived from occupation in good faith, in the manner prescribed by law.
Paragraph 7. The provisions of article 174, paragraphs 3 and 4, shall not apply to Indian lands. (Art. 231) - Portuguese
São reconhecidos aos índios sua organização social, costumes, línguas, crenças e tradições, e os direitos originários sobre as terras que tradicionalmente ocupam, competindo à União demarcá-las, proteger e fazer respeitar todos os seus bens.
§ 1º - São terras tradicionalmente ocupadas pelos índios as por eles habitadas em caráter permanente, as utilizadas para suas atividades produtivas, as imprescindíveis à preservação dos recursos ambientais necessários a seu bem-estar e as necessárias a sua reprodução física e cultural, segundo seus usos, costumes e tradições.
§ 2º - As terras tradicionalmente ocupadas pelos índios destinam-se a sua posse permanente, cabendo-lhes o usufruto exclusivo das riquezas do solo, dos rios e dos lagos nelas existentes.
§ 3º - O aproveitamento dos recursos hídricos, incluídos os potenciais energéticos, a pesquisa e a lavra das riquezas minerais em terras indígenas só podem ser efetivados com autorização do Congresso Nacional, ouvidas as comunidades afetadas, ficando-lhes assegurada participação nos resultados da lavra, na forma da lei.
§ 4º - As terras de que trata este artigo são inalienáveis e indisponíveis, e os direitos sobre elas, imprescritíveis.
§ 5º - É vedada a remoção dos grupos indígenas de suas terras, salvo, "ad referendum" do Congresso Nacional, em caso de catástrofe ou epidemia que ponha em risco sua população, ou no interesse da soberania do País, após deliberação do Congresso Nacional, garantido, em qualquer hipótese, o retorno imediato logo que cesse o risco.
§ 6º - São nulos e extintos, não produzindo efeitos jurídicos, os atos que tenham por objeto a ocupação, o domínio e a posse das terras a que se refere este artigo, ou a exploração das riquezas naturais do solo, dos rios e dos lagos nelas existentes, ressalvado relevante interesse público da União, segundo o que dispuser lei complementar, não gerando a nulidade e a extinção direito a indenização ou a ações contra a União, salvo, na forma da lei, quanto às benfeitorias derivadas da ocupação de boa fé.
§ 7º - Não se aplica às terras indígenas o disposto no art. 174, § 3º e § 4º. (Art. 231)

The State pursues the policy of promoting unity and equality among all ethnic groups. All ethnic groups have the right to protect, preserve and promote the fine customs and cultures of their own and of the nation. All acts creating division and discrimination among ethnic groups are prohibited.

- English(1) The Indigenous Peoples' Commission shall establish mechanisms to enhance the status of indigenous peoples and to respond to their legitimate demands and needs.
(2) The Indigenous Peoples’ Commission shall consist of persons of the categories referred to in sub-paragraphs (a) , (b) and (c) appointed by the President as follows -
(a) not more than ten members nominated by entities, by a consensual mechanism determined by the National Assembly, after the entities are determined by the votes of not less than two-thirds of all elected members of the National Assembly;
(b) three persons, at least one being a woman nominated by the Toushaos Council and two persons including one woman nominated by Amerindian organisations determined by the votes of not less than two-thirds of all elected members of the National Assembly; and
(c) a member who shall be a nominee, without the right to vote, chosen by and from each of the following Commissions: the Human Rights Commission, Ethnic Relations Commission, Women and Gender Equality Commission and the Rights of the Child Commission. (Art. 212S)

- EnglishThe autochthonous Italian and Hungarian national communities and their members shall be guaranteed the right to use their national symbols freely and, in order to preserve their national identity, the right to establish organisations and develop economic, cultural, scientific, and research activities, as well as activities in the field of public media and publishing. In accordance with laws, these two national communities and their members have the right to education and schooling in their own languages, as well as the right to establish and develop such education and schooling. The geographic areas in which bilingual schools are compulsory shall be established by law. These national communities and their members shall be guaranteed the right to foster relations with their nations of origin and their respective countries. The state shall provide material and moral support for the exercise of these rights.
In order to exercise their rights, the members of these communities shall establish their own self-governing communities in the geographic areas where they live. On the proposal of these self-governing national communities, the state may authorise them to perform certain functions under national jurisdiction, and shall provide funds for the performing of such functions.
The two national communities shall be directly represented in representative bodies of local self-government and in the National Assembly.
The position of the Italian and Hungarian national communities and the manner in which their rights are exercised in the geographic areas where they live, the obligations of the self-governing local communities for the exercise of these rights, and those rights which the members of these national communities exercise also outside these areas, shall all be regulated by law. The rights of both national communities and their members shall be guaranteed irrespective of the number of members of these communities.
Laws, regulations, and other general acts that concern the exercise of the constitutionally provided rights and the position of the national communities exclusively, may not be adopted without the consent of representatives of these national communities. (Art. 64) - SloveneAvtohtoni italijanski in madžarski narodni skupnosti ter njunim pripadnikom je zagotovljena pravica, da svobodno uporabljajo svoje narodne simbole in da za ohranjanje svoje narodne identitete ustanavljajo organizacije, razvijajo gospodarske, kulturne in znanstvenoraziskovalne dejavnosti ter dejavnosti na področju javnega obveščanja in založništva. V skladu z zakonom imata ti narodni skupnosti in njuni pripadniki pravico do vzgoje in izobraževanja v svojem jeziku ter do oblikovanja in razvijanja te vzgoje in izobraževanja. Zakon določa območja, na katerih je dvojezično šolstvo obvezno. Narodnima skupnostima in njunim pripadnikom je zagotovljena pravica, da gojijo odnose s svojima matičnima narodoma in njunima državama. Država gmotno in moralno podpira uveljavljanje teh pravic.
Na območjih, kjer ti skupnosti živita, ustanovijo njuni pripadniki za uresničevanje svojih pravic svoje samoupravne skupnosti. Na njihov predlog lahko država pooblasti samoupravne narodne skupnosti za opravljanje določenih nalog iz državne pristojnosti ter zagotavlja sredstva za njihovo uresničevanje.
Narodni skupnosti sta neposredno zastopani v predstavniških organih lokalne samouprave in v državnem zboru.
Zakon ureja položaj in način uresničevanja pravic italijanske oziroma madžarske narodne skupnosti na območjih, kjer živita, obveznosti samoupravnih lokalnih skupnosti za uresničevanje teh pravic, ter tiste pravice, ki jih pripadniki teh narodnih skupnosti uresničujejo tudi zunaj teh območij. Pravice obeh narodnih skupnosti ter njunih pripadnikov so zagotovljene ne glede na število pripadnikov teh skupnosti.
Zakoni, drugi predpisi in splošni akti, ki zadevajo uresničevanje v ustavi določenih pravic in položaja zgolj narodnih skupnosti, ne morejo biti sprejeti brez soglasja predstavnikov narodnih skupnosti. (64. Člen)

- EnglishThe right of the indigenous peoples to preserve and to develop their ethnic identity in the respective habitat is recognized and guaranteed. They have the right, likewise, to freely apply their systems of political, social, economic, cultural, and religious organization, as well as the voluntarily subjection to their customary norms for the regulation of [their] internal coexistence [convivencia], as long as they do not infringe upon the fundamental rights established in this Constitution. Concerning conflicts of jurisdiction the indigenous customary right will be taken into account. (Art. 63)
- SpanishQueda reconocido y garantizado el derecho de los pueblos indígenas a preservar y a desarrollar su identidad étnica en el respectivo hábitat. 2. The Council shall make its own rules of procedure.
3. The Council shall hold at least one meeting a year. Further meetings may be held at the request of the Council, Parliament, or the Government.
