No restriction may be provided to the rights and freedoms guaranteed by this Constitution except by virtue of a law and to meet the demands of a democratic regime and with a view to safeguarding the rights of others or to meet the imperatives of the public safety, of the national defense or of the public health.
These restrictions must not infringe the substance of the rights and freedoms guaranteed by this Constitution, and they must be justified by their objectives and proportionate to their justifications.
No revision may infringe that acquired in the matter of human rights and of freedoms guaranteed by this Constitution.

- English1. Martial law or a state of emergency can only be declared, in the whole or part of the national territory, in cases of effective or imminent foreign aggression, grave threat or disturbance of the democratic constitutional order, or political calamity.
2. The declaration of martial law cannot affect the right to life, integrity and identity, civil capacity and citizenship, non-retroactivity of penal laws, right to defense of the accused and liberty of conscience and religion.
3. The declaration of a state of emergency can only result in the partial suspension of rights, liberties and guarantees. - EnglishIt is recognised and declared that every person in Zambia has been and shall continue to be entitled to the fundamental rights and freedoms of the individual, that is to say, the right, whatever his race, place of origin, political opinions, colour, creed, sex or marital status, but subject to the limitations contained in this Part7, to each and all of the following, namely:
a. life, liberty, security of the person and the protection of the law;
