- EnglishThe President of the Republic, at a meeting of the Cabinet of Ministers, shall have the power to decree states of exception. Expressly defined as such are circumstances of a social, economic, political, natural or ecological nature which seriously affect the security of the Nation, institutions and citizens, in the face of which the powers available to cope with such events are insufficient. In such case, the guarantees contained in this Constitution may be temporarily restricted, with the exception of those relating to the right to life, prohibition of incommunicative detention or torture, the right to due process, the right to information and other intangible human rights. (Art. 337)

During the period in which the state of siege decreed under article 137, I, is in force, only the following measures may be taken against persons:
I – obligation to remain at a specific place;
II – detention in a building not intended for persons accused of or convicted for common crimes;
III – restrictions regarding the inviolability of correspondence, the secrecy of communications, the rendering of information and the freedom of press, radio broadcasting and television, as established by law;
IV – suspension of freedom of assembly;
V – home search and seizure;
VI – intervention in public utility companies;
VII – requisitioning of property.

- EnglishIn cases of war, invasion of the territory, rebellion, sedition, catastrophe, epidemic, or other general calamity, or of serious disturbances to the public order, the guarantees established in Articles 5, 6 [in its] first paragraph, 7 [in its] first paragraph and 24 of this Constitution can be suspended, except when dealing with meetings or associations with religious, cultural, economic or sport purposes. Such suspension can affect all or part of the territory of the Republic, and will be conducted by means of a decree of the Legislative Organ or [of] the Executive Organ, as the case may be.
There can also be the suspension of the guarantees contained in Articles 12 [in its] second paragraph and 13 [in its] second paragraph of this Constitution, when agreed to as such by the Legislative Organ, with the favorable vote of the threefourths part of the elected Deputies; not exceeding the administrative detention of fifteen days. The President of the Republic, in the Council of Ministers[,] can decree, for the totality or part of the national territory and for [a] determined and extendable time [tiempo], the suspension of rights and guarantees when the security of the nation, the economic conditions or some national catastrophe demands it. - EnglishAll persons have the right to an action of amparo in order to demand before the courts, for themselves or by those who act in their name, immediate protection of their fundamental rights, not protected by habeas corpus, when they are violated or threatened by the action or omission of any public authority or of individuals, in order put into effect the fulfillment of a law or administrative act and in order to guarantee collective and diffuse rights and interests. In accordance with the law, the proceeding is preferential, summary, oral, public, free, and not subject to formalities.

The acts adopted during the States of Exception that violate protected rights that unreasonably cause suspended rights are subject to actions of amparo. (Art. 72) - SpanishToda persona tiene derecho a una acción de amparo para reclamar ante los tribunales, por sí o por quien actúe en su nombre, la protección inmediata de sus derechos fundamentales, no protegidos por el hábeas corpus, cuando resulten vulnerados o amenazados por la acción o la omisión de toda autoridad pública o de particulares, para hacer efectivo el cumplimiento de una ley o acto administrativo, para garantizar los derechos e intereses colectivos y difusos. De conformidad con la ley, el procedimiento es preferente, sumario, oral, público, gratuito y no sujeto a formalidades.
Párrafo.- Los actos adoptados durante los Estados de Excepción que vulneren derechos protegidos que afecten irrazonablemente derechos suspendidos están sujetos a la acción de amparo. (Art. 72)
