Limitations and/or Derogations
- English1. Subject to subarticle (2) regulations made by the Council of Ministers in accordance with Article 694 shall have effect notwithstanding the provisions of Chapter 2, Part I5 except that no regulation shall –
a. derogate from the right to life and the freedom from inhuman treatment and forced labour; and
b. make provision for the detention of a person without trial for more than 1 month unless such person is an enemy alien.
2. Regulations made by the Council of Ministers in accordance with Article 69 shall be such as are reasonably necessary in the circumstances of the emergency to which they relate and as are justifiable in a democratic society. - English(1) Subject to paragraphs (3) and (6), every person, as contemplated by the respective international treaties set out in the Fourth Schedule to which Guyana has acceded is entitled to the human rights enshrined in the said international treaties, and such rights shall be respected and upheld by the executive, legislature judiciary and all organs and agencies of Government and, where applicable to them, by all natural and legal persons and shall be enforceable in the manner hereinafter prescribed.

(5) Nothing contained in this article shall be construed so as to abrogate any human right, not enumerated herein, which a person had at the time of the commencement of this Article.

The exercise of the rights and freedoms of the individual enshrined in this Constitution may be suspended only in conditions of state of emergency or martial law in the manner and within the limits determined by the Constitution and the law.

- English(1) Without prejudice to the power of Parliament to make provision in the premise, but subject to this section, where any period of public emergency exists, the President may, due regard being had to the circumstances of any situation likely to arise or exist during such period make regulations for the purpose of dealing with that situation and issue orders and instructions for the purpose of the exercise of any powers conferred on him or any other person by any Act referred to in subsection (3) or instrument made under this section or any such Act.
