- English1. The rights of the human being as an individual and as a member of the society and the principle of the welfare state rule of law are guaranteed by the State. All agents of the State shall be obliged to ensure the unhindered and effective exercise thereof. These rights also apply to the relations between individuals to which they are appropriate. Restrictions of any kind which, according to the Constitution, may be imposed upon these rights, should be provided either directly by the Constitution or by statute, should a reservation exist in the latter’s favour, and should respect the principle of proportionality.

- English1. Martial law or a state of emergency can only be declared, in the whole or part of the national territory, in cases of effective or imminent foreign aggression, grave threat or disturbance of the democratic constitutional order, or political calamity.
2. The declaration of martial law cannot affect the right to life, integrity and identity, civil capacity and citizenship, non-retroactivity of penal laws, right to defense of the accused and liberty of conscience and religion.
3. The declaration of a state of emergency can only result in the partial suspension of rights, liberties and guarantees. (Art. 31) - Portuguese1 - O estado de sítio ou o estado de emergência só podem ser declarados, no todo ou em parte do território nacional, nos casos de agressão efectiva ou eminente por forças estrangeiras, de grave ameaça ou perturbação da ordem constitucional democrática ou de calamidade política.
2 - A declaração do estado de sítio em caso algum pode afectar os direitos à vida, à integridade pessoal e à identidade pessoal, a capacidade civil e a cidadania, a não retroactividade da lei penal, o direito de defesa dos arguidos e a liberdade de consciência e de religião.
3 - A declaração do estado de emergência apenas pode determinar a suspensão parcial dos direitos, liberdades e garantias. (Art. 31)

- EnglishThe territory in which the guarantees mentioned in the preceding article are suspended shall be governed during the suspension, by the state of siege law, but neither that law nor any other may provide for the suspension of any guarantees other than those already mentioned.
Likewise, during the suspension no new offenses may be established or penalties imposed other than those established by laws in force at the time the suspension was decreed. - EnglishThe freedoms and rights of the individual and citizen can be restricted only in cases determined by the Constitution. The freedoms and rights of the individual and citizen can be restricted during states of war or emergency, in accordance with the provisions of the Constitution. The restriction of freedoms and rights cannot discriminate on grounds of sex, race, colour of skin, language, religion, national or social origin, property or social status. The restriction of freedoms and rights cannot be applied to the right to life, the interdiction of torture, inhuman and humiliating conduct and punishment, the legal determination of punishable offences and sentences, as well as to the freedom of personal conviction, conscience, thought, public expression of thought, and religious confession.
