- English1. No derogation from rights contained in this Chapter8 shall be permissible save to the extent provided for by this section and no such derogation shall be made unless there has been a declaration of a state of emergency within the meaning of this section.
2. There shall be no derogation with regard to—
a. the right to life;
b. the prohibition of torture and cruel, inhuman or degrading treatment or punishment;
c. the prohibition of genocide;
d. the prohibition of slavery, the slave trade and slave-like practices;
e. the prohibition of imprisonment for failure to meet contractual obligations;
f. the prohibition on retrospective criminalization and the retrospective imposition of greater penalties for criminal acts;
g. the right to equality and recognition before the law;
h. the right to freedom of conscience, belief, thought and religion and to academic freedom; or
i. the right to habeas corpus.

4. Derogation from the rights contained in this Chapter, other than the rights listed in subsection (2), shall be permissible during a state of emergency within the meaning of this section and to the extent that—
a. such derogation is consistent with the obligations of Malawi under international law; and
b. in the case of—
i. war or threat of war, it is strictly required to prevent the lives of defensive combatants and civilians as well as legitimate military objectives from being placed in direct jeopardy; or
ii. a widespread natural disaster, it is strictly required for the protection and relief of those people and facilities whether in or outside the disaster area.

- EnglishThe tribunals of justice cannot qualify the bases [fundamentos] or the factual circumstances invoked by the authority to decree the states of exception, without prejudice to that provided in Article 39. However, concerning the specific measures which affect constitutional rights, the guarantee of recourse before the judicial authorities by means of the recourses that correspond[,] will always exist.
The requisitions that [have been] made give rise to indemnifications, in conformity with the law. The limitations imposed on the right to ownership[,] when they produce deprivation of any of its essential attributes or faculties and so cause injury, will also give rise to the right of indemnification. - English(1) The exercise of certain rights or freedoms may only be restricted by law, and only if necessary, as the case may be, for: the defence of national security, of public order, health, or morals, of the citizens' rights and freedoms; conducting a criminal investigation; preventing the consequences of a natural calamity, disaster, or an extremely severe catastrophe.
(2) Such restriction shall only be ordered if necessary in a democratic society. The measure shall be proportional to the situation having caused it, applied without discrimination, and without infringing on the existence of such right or freedom. - English(1) Every person shall have the duty to respect the human rights of others in the orderly life of the community, nation and state.
(2) In exercising his/her rights and freedoms, every person shall have the duty to accept the restrictions established by law for the sole purposes of guaranteeing the recognition and respect of the rights and freedoms of others and of satisfying just demands based upon considerations of morality, religious values, security and public order in a democratic society. 2. Human and civil rights and freedoms may be restricted by the Constitution and laws to protect national security, public order, public health and morals and to protect the rights and freedoms of others. Such restrictions may also be imposed taking into account the peculiarities of military or other state service. Restrictions imposed must be proportionate to the stated objectives.
3. The adoption of by-laws restricting human and civil rights and freedoms shall be prohibited.
4. Restrictions on human rights and freedoms may not be imposed by law for other purposes or to a greater extent than those provided for in the Constitution.

- English(1) In addition to complying with section 3, when interpreting and applying this Chapter, a court, tribunal or other authority—
(a) must promote the values that underlie a democratic society based on human dignity, equality and freedom; and
(b) may, if relevant, consider international law, applicable to the protection of the rights and freedoms in this Chapter.
(2) This Chapter does not deny, or prevent the recognition of, any other right or freedom recognised or conferred by common law or written law, except to the extent that it is inconsistent with this Chapter.
(3) A law that limits a right or freedom set out in this Chapter is not invalid solely because the law exceeds the limits imposed by this Chapter if the law is reasonably capable of a more restricted interpretation that does not exceed those limits, and in that case, the law must be construed in accordance with the more restricted interpretation.

- EnglishThe enunciation of the rights and guarantees contained in this Constitution must not be understood as the negation of others that, being inherent to the human personality, do not expressively figure in it. The lack of [a] regulatory law may not be invoked to deny or to curtail any right or guarantee. (Art. 45)
