- EnglishThe interpretation and regulation of the fundamental rights and guarantees, recognized in the present Constitution, shall be ruled by the following principles:
1. They do not have limiting character and consequently, do not exclude other rights and guarantees of an equal nature.
2. Only by law, in the cases permitted by this Constitution, may the exercise of the fundamental rights and guarantees be regulated, respecting their essential content and the principle of reasonableness.
3. Treaties, pacts, and conventions related to human rights, adopted and ratified by the Dominican State have constitutional hierarchy and are for direct and immediate application by the courts and other organs of the State.
4. The public powers interpret and apply the norms related to fundamental rights and their guarantees, in the sense most favorable to the person in possession of the same, in the case of conflict between fundamental rights, they shall attempt to harmonize the assets and interests protected by this Constitution. - EnglishThe enactment of a law resulting in the restriction of rights or liberties of a person shall be in accordance with the conditions provided by the Constitution. In the case where the Constitution does not provide the conditions thereon, such law shall not be contrary to the rule of law, shall not unreasonably impose burden on or restrict the rights or liberties of a person and shall not affect the human dignity of a person, and the justification and necessity for the restriction of the rights or liberties shall also be specified.
The law under paragraph one shall be of general application, and shall not be intended to apply to any particular case or person. Limitations and/or Derogations
- English1. The exercise of the rights, freedoms and guarantees of citizens may only be limited or suspended in the event of a state of war, siege or emergency, under the terms of the Constitution and the law.
2. A state of war, siege or emergency may only be declared in part or all of national territory in cases of actual or imminent aggression by foreign forces, serious threat to, or disturbance of, the constitutional democratic order, or public disaster.
3. The decision to opt for a state of war, siege or emergency, in addition to its declaration and implementation must always be limited to the necessary and appropriate actions required to maintain public order and protect general interests, observing the principle of proportionality and being limited, particularly with regard to extent and duration and the means employed, to that which is strictly necessary to promptly restore constitutional normality.
4. The declaration of a state of war, siege or emergency shall confer on the public authorities the power and responsibility to take the appropriate steps needed to restore constitutional normality.
5. Under no circumstances may the declaration of a state of war, siege or emergency effect:
a) The application of constitutional rules concerning the responsibilities and functioning of the bodies that exercise sovereign power;
b) The rights and immunities of the members of bodies that exercise sovereign power;
c) The right to life, personal integrity and personal identity;
d) Civil capacity and citizenship;
e) The non-retroactive nature of criminal law;
f) The right to a defence;
g) Freedom of conscience and religion.
6. Special law shall regulate the state of war, siege or emergency. (Art. 58) - Portuguese1. O exercício dos direitos, liberdades e garantias dos cidadãos apenas pode ser limitado ou suspenso em caso de estado de guerra, de estado de sítio ou de estado de emergência, nos termos da Constituição e da lei.
2. O estado de guerra, o estado de sítio e o estado de emergência só podem ser declarados, no todo ou em parte do território nacional, nos casos de agressão efectiva ou iminente por forças estrangeiras, de grave ameaça ou perturbação da ordem constitucional democrática ou de calamidade pública.
3. A opção pelo estado de guerra, estado de sítio ou estado de emergência, bem como a respectiva declaração e execução, devem sempre limitar-se às acções necessárias e adequadas à manutenção da ordem pública, à protecção do interesse geral, ao respeito do princípio da proporcionalidade e limitar-se, nomeadamente quanto à sua extensão, duração e meios utilizados, ao estritamente necessário ao pronto restabelecimento da normalidade constitucional.
4. A declaração do estado de guerra, do estado de sítio ou do estado de emergência confere às autoridades competência para tomarem as providências necessárias e adequadas ao pronto restabelecimento da normalidade constitucional.
5. Em caso algum a declaração do estado de guerra, do estado de sítio ou do estado de emergência pode afectar:
a) A aplicação das regras constitucionais relativas à competência e ao funcionamento dos órgãos de soberania;
b) Os direitos e imunidades dos membros dos órgãos de soberania;
c) O direito à vida, à integridade pessoal e à identidade pessoal;
d) A capacidade civil e a cidadania;
e) A não retroactividade da lei penal;
f) O direito de defesa dos arguidos;
g) A liberdade de consciência e de religião.
6. Lei especial regula o estado de guerra, o estado de sítio e o estado de emergência. (Art. 58)

(2) The provisions of Title 1 of Part 26 shall have effect for the purpose of affording protection to the aforesaid fundamental rights and freedoms of the individual subject to such limitations of that protection as are contained in those provisions, being limitations designed to ensure that the enjoyment of the said rights and freedoms by any individual does not prejudice the rights and freedoms of others or the public interest. 1. Extraordinary measures may be imposed due to a state of war, state of emergency, or state of natural disaster and last for as long as these states continue.
2. The principles of the activity of public bodies, as well as the extent of limitations on human rights and freedoms during the period of the existence of situations that require extraordinary measures, are defined by law.
3. The law must define the principles, areas and manner of compensation for losses caused as a result of the limitation of human rights and freedoms during the period in which extraordinary measures are imposed.
4. Acts taken as a result of extraordinary measures shall be in proportion with the level of risk and shall aim to re-establish the conditions for the normal functioning of the state, as soon as possible.
5. During the situations that require the imposition of extraordinary measures, none of these acts may be amended: the Constitution, the laws on the election of the Assembly and organs of local government, as well as the laws on extraordinary measures.
6. During the period of implementation of extraordinary measures, there may not be held elections for local government bodies, there may not be a referendum, and a new President of the Republic may not be elected. The elections for the local government bodies may be held only in those places where the extraordinary measures are not implemented. (Art. 170) - Albanian
1. Masat e jashtëzakonshme mund të vendosen për shkak të gjendjes së luftës, gjendjes së jashtëzakonshme ose gjendjes së fatkeqësisë natyrore dhe zgjatin për aq kohë sa vazhdojnë këto gjendje.
2. Parimet e veprimtarisë së organeve publike dhe shkalla e kufizimit të të drejtave dhe lirive të njeriut gjatë gjithë periudhës së ekzistencës së gjendjeve që kërkojnë marrjen e masave të jashtëzakonshme, përcaktohen me ligj.
3. Ligji duhet të përcaktojë parimet, fushat dhe mënyrën e kompensimit të humbjeve që vijnë si rezultat i kufizimit të të drejtave dhe lirive gjatë marrjes së masave të jashtëzakonshme.
4. Aktet që ndërmerren si pasojë e marrjes së masave të jashtëzakonshme, duhet të jenë në përpjesëtim me shkallën e rrezikut dhe duhet të synojnë rivendosjen sa më të shpejtë të kushteve për funksionimin normal të shtetit.
5. Gjatë gjendjeve që kërkojnë marrjen e masave të jashtëzakonshme, nuk mund të ndryshohet asnjë prej këtyre akteve: Kushtetuta, ligjet për zgjedhjet për Kuvendin dhe për organet e pushtetit vendor, si dhe ligjet për masat e jashtëzakonshme.
6. Gjatë periudhës së zbatimit të masave të jashtëzakonshme nuk mund të zhvillohen zgjedhje vendore, nuk mund të zhvillohet referendum, si dhe nuk mund të zgjidhet një President i ri i Republikës. Zgjedhjet vendore mund të bëhen vetëm aty ku nuk zbatohen masat e jashtëzakonshme. (Neni 170)

- EnglishIn the case of [an] armed international conflict, formally declared or not, or of a grave internal commotion that puts in imminent danger the rule [imperio] of this Constitution or the regular functioning of the organs created by it, the Congress or the Executive Power may declare the State of Exception in all or in part of the national territory, for a term of sixty days maximum. In the case that such declaration is effected by the Executive Power, the measure must be approved or rejected by the Congress within a time period of forty-eight hours.

The decree or the law that declares the State of Exception will contain the reasons and the facts invoked for its adoption, the time of its enforcement and the territory affected, as well as the rights that it restricts.
During the enforcement of the State of Exception, the Executive Power may only order, by decree and in each case, the following measures: the detention of the persons indicted [indiciadas] for participating in some of those acts, their transfer from one point to another of the Republic, as well as the prohibition or the restriction of public meetings and of demonstrations.
In all the cases, the persons indicted [indiciadas] will have the option to leave the country.
