- EnglishThe exercise of the rights established in articles 69, 71, 72, 78, 81, 84, 93, 99 and 103 may be suspended in the event of invasion of the national territory, serious disturbance of the peace, an epidemic, or other general disaster, or by the president of the republic in agreement with the Council of Ministers, by means of a decree that shall contain:
1. The reasons justifying the suspension;
2. The guarantee or guarantees that are restricted;
3. The territory to be affected by the restriction; and
4. The duration of the restriction. In addition, Congress shall be convened by the same decree in order that, within a period of thirty days, it may take cognizance of the decree and ratify, modify, or reject it.
In the event that Congress is in session, it shall take immediate cognizance of the decree.
The restriction of guarantees shall not exceed a period of forty-five days for each time it is decreed.
If before the expiration of the period set for the restriction the causes underlying the decree have disappeared, it shall cease to be effective and, in this case, every citizen shall have the right to urge its revision. Upon expiration of the period of forty-five days, the guarantees shall be restored automatically unless a new restriction has been decreed.
Restriction of guarantees decreed shall in no way affect the functioning of the state agencies, whose members shall always enjoy the immunities and privileges granted by law. Si antes de que venza el plazo señalado para la restricción, hubieren desaparecido las causas que motivaron el decreto, se hará cesar en sus efectos, y en este caso todo ciudadano tiene el derecho para instar su revisión. Vencido el plazo de (45) cuarenta y cinco días, automáticamente quedan restablecidas las garantías, salvo que se hubiere dictado nuevo decreto de restricción.
La restricción de garantías decretada, en modo alguno afectará el funcionamiento de los organismos del Estado, cuyos miembros gozarán siempre de las inmunidades y prerrogativas que les conceda la ley. (Art. 187)

To the extent provided for in Articles 21 to 24, the following rights and freedoms may be restricted in law:
1. freedom of expression, freedom of information, freedom of assembly, freedom to demonstrate and freedom of association (Article 1, points 1 to 5);
2. protection against any physical violation in cases other than cases under Articles 4 and 5, against body searches, house searches and other such invasions of privacy, against violations of confidential items of mail or communications and otherwise against violations involving surveillance and monitoring of the individual’s personal circumstances (Article 6);
3. freedom of movement (Article 8); and
4. public court proceedings (Article 11, paragraph two, sentence two).
With authority in law, the rights and freedoms referred to in paragraph one may be restricted by other statute in cases under Chapter 8, Article 5, and in respect of prohibition of the disclosure of matters which have come to a person’s knowledge in the performance of public or official duties. Följande fri- och rättigheter får, i den utsträckning som medges i 21–24 §§, begränsas genom lag:
1. yttrandefriheten, informationsfriheten, mötesfriheten, demonstrationsfriheten och föreningsfriheten (1 § första stycket 1–5),
2. skyddet mot annat kroppsligt ingrepp än som avses i 4 och 5 §§, mot kroppsvisitation, husrannsakan och liknande intrång, mot intrång i förtroliga försändelser och meddelanden samt i övrigt mot intrång som innebär övervakning och kartläggning av den enskildes personliga förhållanden (6 §),
3. rörelsefriheten (8 §), och
4. offentligheten vid domstolsförhandling (11 § andra stycket andra meningen).
Efter bemyndigande i lag får de i första stycket angivna fri- och rättigheterna begränsas genom annan författning i de fall som anges i 8 kap. 5 § och i fråga om förbud att röja sådant som någon fått kännedom om i allmän tjänst eller under utövande av tjänsteplikt. - English(1) Without prejudice to the powers of Parliament, but subject to the provisions of this section, where any period of public emergency exists, the Governor General may, due regard being had to the circumstances of any situation likely to arise or exist during such period, make regulations for the purpose of dealing with that situation and issue orders and instructions for the purpose of the exercise of any powers conferred on him or her or any other person by any law referred to in subsection (3) or instrument made under this section or any such law.
(2) Without prejudice to the generality of subsection (1) regulations made under that subsection may make provision for the detention of persons.
(3) A law enacted by Parliament that is passed during a period of public emergency and is expressly declared to have effect only during that period or any regulation made under subsection (1) shall have effect even though inconsistent with sections 3 or 13 except in so far as its provisions may be shown not to be reasonably justifiable for the purpose of dealing with the situation that exists during that period. - English(a) If required to preserve public peace, health, or safety at a time of extreme emergency caused by civil disturbance, natural disaster, or immediate threat of war, or insurrection, the President may declare a state of emergency and issue appropriate decrees.
(b) A civil right may be impaired only to the extent actually required for the preservation of peace, health, or safety. A declaration of emergency may not impair the power of the judiciary except that the declaration shall be free from judicial interference for 30 days after it is first issued.
