Limitations and/or Derogations
- English1. Martial law or a state of emergency can only be declared, in the whole or part of the national territory, in cases of effective or imminent foreign aggression, grave threat or disturbance of the democratic constitutional order, or political calamity.
2. The declaration of martial law cannot affect the right to life, integrity and identity, civil capacity and citizenship, non-retroactivity of penal laws, right to defense of the accused and liberty of conscience and religion.
3. The declaration of a state of emergency can only result in the partial suspension of rights, liberties and guarantees. (Art. 31) - Portuguese1 - O estado de sítio ou o estado de emergência só podem ser declarados, no todo ou em parte do território nacional, nos casos de agressão efectiva ou eminente por forças estrangeiras, de grave ameaça ou perturbação da ordem constitucional democrática ou de calamidade política.

- English(1) Without prejudice to the powers of Parliament, but subject to the provisions of this section, where any period of public emergency exists, the Governor General may, due regard being had to the circumstances of any situation likely to arise or exist during such period, make regulations for the purpose of dealing with that situation and issue orders and instructions for the purpose of the exercise of any powers conferred on him or her or any other person by any law referred to in subsection (3) or instrument made under this section or any such law.
(2) Without prejudice to the generality of subsection (1) regulations made under that subsection may make provision for the detention of persons.
(3) A law enacted by Parliament that is passed during a period of public emergency and is expressly declared to have effect only during that period or any regulation made under subsection (1) shall have effect even though inconsistent with sections 3 or 13 except in so far as its provisions may be shown not to be reasonably justifiable for the purpose of dealing with the situation that exists during that period. The restrictions referred to in Article 20 may only be imposed to satisfy purposes acceptable in a democratic society. The restriction may never go beyond what is necessary with regard to the purposes for which it was imposed, nor may it extend so far that it represents a threat to the free shaping of opinion as one of the foundations of democracy. No restriction may be imposed solely on grounds of political, religious, cultural or other such beliefs. (Instrument of Government, Chapter 2, Art. 21)
