- EnglishHuman rights and fundamental freedoms provided by this Constitution may exceptionally be temporarily suspended or restricted during a war and state of emergency. Human rights and fundamental freedoms may be suspended or restricted only for the duration of the war or state of emergency, but only to the extent required by such circumstances and inasmuch as the measures adopted do not create inequality based solely on race, national origin, sex, language, religion, political or other conviction, material standing, birth, education, social status or any other personal circumstance.
The provision of the preceding paragraph does not allow any temporary suspension or restriction of the rights provided by Articles 17, 18, 21, 27, 28, 29 and 41. - English(1) While a Proclamation of Emergency is in operation, the President may, on the written advice of the Prime Minister, by order], declare that the right to move any court for the enforcement of such of the rights conferred by Part III of this Constitution as may be specified in the order, and all proceedings pending in any court for the enforcement of the right so specified, shall remain suspended for the period during which the Proclamation is in force or for such shorter period as may be specified in the order.
(2) An order made under this article may extend to the whole of Bangladesh or any part thereof.
(3) Every order made under this article shall, as soon as may be, be laid before Parliament. Limitations and/or Derogations
- English(1) When a Proclamation of Emergency has been made and so long as it remains in force, the Head of State may from time to time make such Orders (hereinafter referred to as Emergency Orders) as appear to him to be necessary or expedient for securing the public safety, the defence of Samoa and the efficient prosecution of any war in which Samoa may be engaged, for maintaining public order and the supplies and services essential to the life of the community, and generally for safeguarding the interests and maintaining the welfare of the community.
(2) Emergency Orders may empower or provide for empowering such authorities, persons or classes of persons as may be specified in the Orders to make regulations, rules or bylaws for any of the purposes for which Emergency Orders are authorised under the provisions of this Article to be made, and may contain such incidental and supplementary provisions as appear to the Head of State to be necessary or expedient for making effective the powers conferred under the provisions of clause (1).
(3) Every Emergency Order, if otherwise valid, shall have effect notwithstanding anything contained in Part II.
(4) No provision of any Emergency Order, and no regulation, rule or by-law duly made under the provisions of any such Order, shall be invalid because it deals with any matter already provided for under any law or because of any inconsistency with any such law. No restriction may be provided to the rights and freedoms guaranteed by this Constitution except by virtue of a law and to meet the demands of a democratic regime and with a view to safeguarding the rights of others or to meet the imperatives of the public safety, of the national defense or of the public health.
These restrictions must not infringe the substance of the rights and freedoms guaranteed by this Constitution, and they must be justified by their objectives and proportionate to their justifications.
No revision may infringe that acquired in the matter of human rights and of freedoms guaranteed by this Constitution.

لا توضع قيود على الحقوق والحرّيات المضمونة بهذا الدّستور إلاّ بمقتضى قانون ولضرورة يقتضيها نظام ديمقراطيّ وبهدف حماية حقوق الغير أو لمقتضيات الأمن العامّ أو الدّفاع الوطنيّ أو الصّحة العموميّة.
ويجب ألاّ تمسّ هذه القيود بجوهر الحقـــوق والحرّيات المضمونة بهذا الدّستور وأن تكون مبرّرة بأهدافها، متناسبة مع دواعيها.
لا يجوز لأيّ تنقيح أن ينال من مكتسبات حقوق الإنسان وحرّياته المضمونة في هذا الدّستور.

Aucune restriction ne peut être apportée aux droits et libertés garantis par la présente Constitution qu'en vertu d'une loi et pour répondre aux exigences d’un régime démocratique et en vue de sauvegarder les droits d’autrui ou pour répondre aux impératifs de la sûreté publique, de la défense nationale ou de la santé publique.
Ces restrictions ne doivent pas porter atteinte à la substance des droits et libertés garantis par la présente Constitution, et elles doivent être justifiées par leurs objectifs et proportionnelles à leurs justifications.
