An individual who possesses an urban area of up to two hundred and fifty square meters, for five years, without interruption or opposition, using it as his or as his family’s home, shall acquire domain of it, provided that he does not own any other urban or rural property.
Paragraph 1. The deed of domain and concession of use shall be granted to the man or woman, or both, regardless of their marital status.
Paragraph 2. This right shall not be recognized for the same holder more than once.

- EnglishTongan male subjects by birth of or over the age of 16 years may be granted town allotments and tax allotments out of estates granted in pursuance of this Constitution with the consent of or upon consultation with the estate holder and out of the lands of the Crown, by the Minister of Lands. Such allotments shall be hereditary and shall be of such size and at an annual rent as may be determined by law. (2) Subject to the provisions of subsection (5), no law shall make any provision which is discriminatory either of itself or in its effect.
