- English(1) After the Shari’ah, the Constitution of the Federal Republic of Somalia is the supreme law of the country. It binds the government and guides policy initiatives and decisions in all sections of government.
(2) Any law, or administrative action that is contrary to the Constitution may be invalidated by the Constitutional Court, which has the authority to do so in accordance with this Constitution. In the case of referral [of a matter] to the Constitutional Council by way of action, a law or a provision declared contrary to the Constitution[,] it may not be promulgated or applied. The law or the provision contrary to the Constitution is null with respect to all.
In the case of referral [of a matter] to the Constitutional Council by way of pleadings [exception], the decision of the Constitutional Council is imposed on all, beyond the parties or the process. The law or the provision declared unconstitutional by the Constitutional Council is abrogated.

En cas de saisine du Conseil constitutionnel par voie d’action, une loi ou une disposition déclarée contraire à la Constitution ne peut être promulguée ou mise en application. La loi ou la disposition contraire à la Constitution est nulle à l’égard de tous.
En cas de saisine du Conseil constitutionnel par voie d’exception, la décision du Conseil constitutionnel s’impose à tous, au-delà des parties au procès. La loi ou la disposition déclarée inconstitutionnelle par le Conseil constitutionnel est abrogée.
