- EnglishIf the Constitutional Council, on a referral from the President of the Republic, from the Prime Minister, from the President of one or the other Houses, or from sixty Members of the National Assembly or sixty Senators, has held that an international undertaking contains a clause contrary to the Constitution, authorization to ratify or approve the international undertaking involved may be given only after amending the Constitution. - EnglishWhen the Constitutional Court establishes that the law is not in conformity with the Constitution and confirmed and published international agreements, that is, that other regulation is not in conformity with the Constitution and the law, that law and other regulation shall cease to be valid on the date of publication of the decision of the Constitutional Court.
The law or other regulation, i.e. their individual provisions that were found inconsistent with the Constitution or the law by the decision of the Constitutional Court, shall not be applied to the relations that have occurred prior to the publication of the Constitutional Court decision, if they have not been solved by an absolute ruling by that date. 2. However, in the case of unconstitutionality or illegality due to breach of a subsequent constitutional or legal norm, the declaration only has effect as of the moment at which the latter came into force.

In the case of review of an act of law under paragraph one, particular attention must be paid to the fact that the Riksdag is the foremost representative of the people and that fundamental law takes precedence over other law. Ein Staatsvertrag, dessen Verfassungs- oder Gesetzwidrigkeit der Verfassungsgerichtshof feststellt, ist mit Ablauf des Tages der Kundmachung des Erkenntnisses von den zu seiner Vollziehung berufenen Organen nicht mehr anzuwenden, wenn nicht der Verfassungsgerichtshof eine Frist bestimmt, innerhalb der der Staatsvertrag weiterhin anzuwenden ist; diese Frist darf bei den politischen, gesetzändernden und gesetzesergänzenden Staatsverträgen und bei den Staatsverträgen, durch die die vertraglichen Grundlagen der Europäischen Union geändert werden, zwei Jahre, bei allen anderen Staatsverträgen ein Jahr nicht überschreiten.
