Status of the Constitution
- English1. The Constitution is the fundamental and supreme law of the Socialist Republic of Vietnam.
All other legal documents must conform to the Constitution.
All violations of the Constitution shall be dealt with.
2. The National Assembly and its agencies, the President, the Government, People’s Courts, People’s Procuracies, other agencies of the State and all the People shall defend the Constitution.
The mechanism to defend the Constitution shall be prescribed by a law. (Art. 119) - Vietnamese1. Hiến pháp là luật cơ bản của nước Cộng hoà xã hội chủ nghĩa Việt Nam, có hiệu lực pháp lý cao nhất.

Status of the Constitution
- EnglishA local government and its agencies may continue to exist even though its charter or powers are inconsistent with this Constitution. To promote an orderly transition to the provisions of this Constitution, and until state governments are established, Congress shall provide for the resolution of inconsistencies between local government charters and powers, and this Constitution. The international treaties and instruments in matters of human rights that have been signed and/or ratified, or those that have been joined by the State, which declare rights more favorable than those contained in the Constitution, shall have preferential application over those in this Constitution.
II. The rights recognized in the Constitution shall be interpreted in agreement with international human rights treaties when the latter provide more favorable norms. (Art. 256) - SpanishI.
