Status of the Constitution
- EnglishWhen the Constitutional Court establishes that the law is not in conformity with the Constitution and confirmed and published international agreements, that is, that other regulation is not in conformity with the Constitution and the law, that law and other regulation shall cease to be valid on the date of publication of the decision of the Constitutional Court.
The law or other regulation, i.e. their individual provisions that were found inconsistent with the Constitution or the law by the decision of the Constitutional Court, shall not be applied to the relations that have occurred prior to the publication of the Constitutional Court decision, if they have not been solved by an absolute ruling by that date. - EnglishIf the Constitutional Court consulted by the President of the Republic, by the Prime Minister, the President of the National Assembly or the President of the Senate, by a tenth of the Deputies or a tenth of the Senators, declares that an international treaty or agreement includes a clause contrary to the Constitution, the ratification or approval may only intervene after the revision of the Constitution. (1) The existing law shall continue to be in force but shall be construed with such modifications, adaptations, qualifications and exceptions as may be necessary to bring it into conformity with sections 12 to 235 of this Constitution.
(2) For the purpose of this section “existing law” means a law that
(a) was enacted or made before 30th November, 1966 and has continued to be part of the law of Barbados at all times since that day;
(b) re-enacted a law that was enacted or made before 30th November, 1966 without alteration; or
(c) altered a law that was enacted or made before 30th November, 1966 and does not thereby render that law inconsistent with sections 12 to 23 of this Constitution in a manner in which, or to an extent to which, it was not previously so inconsistent.
