Sao Tome and Principe
- English1. If the Constitutional Court rules that a provision of any statute or international agreement is unconstitutional by regular standard, it should be vetoed by the President of the Republic and returned to the body that had approved it.
2. In the case referred to in paragraph 1, the statute may not be promulgated unless the organ that approved it deletes the provision ruled unconstitutional or, as the case may be, it shall confirm by a majority of two thirds of the Deputies present, so long as it is higher than the absolute majority of the sitting Deputies in office.
3. If the law were to be reformulated, the President may request prior review of the constitutionality of any of its provisions.
4. If the Constitutional Court rules that a provision of unconstitutionality agreement or treaty, it may only be ratified if the National Assembly approves it by a majority of two thirds of the Deputies present, provided that that exceeds an absolute majority of the sitting Deputies. Se o Tribunal Constitucional se pronunciar pela inconstitucionalidade de norma constante de qualquer diploma ou acordo internacional, deverá o mesmo ser vetado pelo Presidente da República e devolvido ao órgão que o tiver aprovado.

Se o Tribunal Constitucional se pronunciar pela inconstitucionalidade de norma constante de acordo ou tratado, este só poderá ser ratificado se a Assembleia Nacional vier a aprovar por maioria de dois terços dos Deputados presentes, desde que superior à maioria absoluta dos Deputados em efectividade de funções. - EnglishAll provisions embodied in laws and regulations in force upon the entering of this Constitution into force shall continue to be valid and effective unless they are amended in accordance with it. Cabo Verde
- English1. If the Constitutional Court rules in favor of the unconstitutionality of a rule contained in an international treaty or agreement, the latter must not be ratified by the President of the Republic, who shall return it to the organ that had approved it.
2. An international treaty or agreement that contains a rule declared to be unconstitutional may be ratified by the President of the Republic if the National Assembly, in consulting the Government, confirms its approval by a majority of two thirds of the Deputies in full exercise of their functions.
3. If the Constitutional Court rules in favor of the unconstitutionality of a rule contained in any legislative act, the instrument must be vetoed by the President of the Republic and returned to the organ that had approved it.
4. In the case foreseen in paragraph 3, the legislative act may not be promulgated unless the organ that had approved it expurgates therefrom the rule judged unconstitutional or, where appropriate, confirms it by a two-thirds majority of Deputies in full exercise of their functions. San Marino
- EnglishThe Republic of San Marino receives generally recognised rules of international law as integral part of its constitutional order, to which it shall conform its acts and conduct. It recognises the provisions set forth in the international declarations on human rights and fundamental freedoms.
It reasserts the right to political asylum. It rejects war as a means to settle disputes between States and, in its international policy, adheres to the principles enshrined in the Charter of the United Nations.
San Marino constitutional order recognises, guarantees and enforces the rights and fundamental freedoms set forth by the European Convention for the Protection of Human Rights and Fundamental Freedoms.
Regularly signed and implemented international agreements on the protection of human rights and freedoms shall prevail over domestic legislation in case of conflict. L'ordinamento sammarinese riconosce, garantisce ed attua i diritti e le libertà fondamentali enunciate nella Convenzione Europea per la salvaguardia dei diritti dell'uomo e delle libertà fondamentali.
Gli accordi internazionali in tema di protezione delle libertà e dei diritti dell'uomo, regolarmente stipulati e resi esecutivi, prevalgono in caso di contrasto sulle norme interne. (Art. 1)
