(3) Where the High Court or the Court of Appeal is seised of an issue the resolution of which involves a question concerning the interpretation or application of the Treaty, the High Court or the Court of Appeal, as the case may be, shall, if it considers that a decision on the question is necessary to enable it to deliver judgment, refer the question to the Caribbean Court of Justice for determination before delivering judgment. - EnglishInternational treaties and agreements ratified by the Congress that recognize human rights and that prohibit their limitation in the states of emergency, have prevalence in the internal order. The rights and duties consecrated in this Charter will be interpreted in conformity with international treaties on human rights ratified by Colombia.
The Colombian State can recognize the jurisdiction of the International Criminal Court in the terms specified in the Statute of Rome adopted on 17 of July of 1998 by the Plenipotentiary Conference of the United Nations and, consequently, to ratify this treaty in accordance within the procedure established in this Constitution.
The admission of a substantial disparity in treatment by the Statute of Rome with respect to the guarantees contained in the Constitution will have effects exclusively within the scope of the matter regulated in it. The absence of a law regulating these rights shall not adversely affect the exercise thereof. (Art. 22)

II. The rights recognized in the Constitution shall be interpreted in agreement with international human rights treaties when the latter provide more favorable norms. (Art. 256) - SpanishI. Los tratados e instrumentos internacionales en materia de derechos humanos que hayan sido firmados, ratificados o a los que se hubiera adherido el Estado, que declaren derechos más favorables a los contenidos en la Constitución, se aplicarán de manera preferente sobre ésta.
II. Los derechos reconocidos en la Constitución serán interpretados de acuerdo a los tratados internacionales de derechos humanos cuando éstos prevean normas más favorables. (Art. 256)

- EnglishAll persons, authorities and institutions are subject to the Constitution.
The judges, administrative authorities, and public servants shall directly apply constitutional standards and those provided for in international human rights instruments, as long as the latter are more favorable than those set forth in the Constitution, although the parties do not invoke them expressly.
The rights enshrined in the Constitution and international human rights instruments shall be for immediate observance and enforcement. The absence of a law or lack of knowledge about the norms cannot be alleged to justify the violation of rights and guarantees enshrined in the Constitution, to dismiss proceedings for their defense, or to refuse recognition of these rights. (Art. 426) - SpanishTodas las personas, autoridades e instituciones están sujetas a la Constitución.
Las juezas y jueces, autoridades administrativas y servidoras y servidores públicos, aplicarán directamente las normas constitucionales y las previstas en los instrumentos internacionales de derechos humanos siempre que sean más favorables a las establecidas en la Constitución, aunque las partes no las invoquen expresamente.
Los derechos consagrados en la Constitución y los instrumentos internacionales de derechos humanos serán de inmediato cumplimiento y aplicación. No podrá alegarse falta de ley o desconocimiento de las normas para justificar la vulneración de los derechos y garantías establecidos en la Constitución, para desechar la acción interpuesta en su defensa, ni para negar el reconocimiento de tales derechos.
