Status of International Law
- English(1) The Romanian State pledges to fulfil as such and in good faith its obligations as deriving from the treaties it is a party to.
(2) Treaties ratified by Parliament, according to the law, are part of national law.
(3) If a treaty Romania is to become a party to comprises provisions contrary to the Constitution, its ratification shall only take place after the revision of the Constitution. (Art. 11) - Romanian(1) Statul român se obligă să îndeplinească întocmai şi cu bună-credinţă obligaţiile ce-i revin din tratatele la care este parte.
(2) Tratatele ratificate de Parlament, potrivit legii, fac parte din dreptul intern.
(3) În cazul în care un tratat la care România urmează să devină parte cuprinde dispoziţii contrare Constituţiei, ratificarea lui poate avea loc numai după revizuirea Constituţiei. (Art. 11)

- EnglishAll persons have the right to the recourse of habeas corpus to guarantee their personal freedom and integrity, and to the recourse of amparo to maintain or reestablish the enjoyment of the other rights consecrated in this Constitution, as well as those of a fundamental character established in the international instruments concerning human rights, applicable in the Republic. Both recourses will be of the competence of the Chamber indicated in Article 10. (Art. 48)

- EnglishAll persons, authorities and institutions are subject to the Constitution.
The judges, administrative authorities, and public servants shall directly apply constitutional standards and those provided for in international human rights instruments, as long as the latter are more favorable than those set forth in the Constitution, although the parties do not invoke them expressly.
The rights enshrined in the Constitution and international human rights instruments shall be for immediate observance and enforcement. The absence of a law or lack of knowledge about the norms cannot be alleged to justify the violation of rights and guarantees enshrined in the Constitution, to dismiss proceedings for their defense, or to refuse recognition of these rights. Las juezas y jueces, autoridades administrativas y servidoras y servidores públicos, aplicarán directamente las normas constitucionales y las previstas en los instrumentos internacionales de derechos humanos siempre que sean más favorables a las establecidas en la Constitución, aunque las partes no las invoquen expresamente.
Los derechos consagrados en la Constitución y los instrumentos internacionales de derechos humanos serán de inmediato cumplimiento y aplicación. Status of International Law
- EnglishThe State has the duty to assure the diffusion and the teaching of the Constitution, of the Universal Declaration of the Rights of Man of 1948, of the African Charter of the Rights of Man and of Peoples of 1981 as well as of all international instruments duly ratified relative to Human Rights.
The State must integrate the rights of the human person in the programs of literacy [alphabétisation] and of teaching in the different schooling and university cycles and in all the programs of training of the armed forces, the forces of public security and similar forces.
The State must equally assure in the national languages by all means of mass communication, in particular by radio and television, the diffusion and the teaching of these same rights.
