Status of International Law
- English1. The norms and principles of general or common international law form an integral part of Portuguese law.
2. The norms contained in duly ratified or approved international conventions come into force in Portuguese internal law once they have been officially published, and remain so for as long as they are internationally binding on the Portuguese state.
3. The norms issued by the competent organs of international organisations to which Portugal belongs come directly into force in Portuguese internal law, on condition that this is laid down in the respective constituent treaties.
4. The provisions of the treaties that govern the European Union and the norms issued by its institutions in the exercise of their respective competences are applicable in Portuguese internal law in accordance with Union law and with respect for the fundamental principles of a democratic state based on the rule of law. 2. As normas constantes de convenções internacionais regularmente ratificadas ou aprovadas vigoram na ordem interna após a sua publicação oficial e enquanto vincularem internacionalmente o Estado Português.
3. As normas emanadas dos órgãos competentes das organizações internacionais de que Portugal seja parte vigoram directamente na ordem interna, desde que tal se encontre estabelecido nos respectivos tratados constitutivos.
4. As disposições dos tratados que regem a União Europeia e as normas emanadas das suas instituições, no exercício das respectivas competências, são aplicáveis na ordem interna, nos termos definidos pelo direito da União, com respeito pelos princípios fundamentais do Estado de direito democrático. Status of International Law
- EnglishThe Republic of San Marino receives generally recognised rules of international law as integral part of its constitutional order, to which it shall conform its acts and conduct. It recognises the provisions set forth in the international declarations on human rights and fundamental freedoms.
It reasserts the right to political asylum. It rejects war as a means to settle disputes between States and, in its international policy, adheres to the principles enshrined in the Charter of the United Nations.
San Marino constitutional order recognises, guarantees and enforces the rights and fundamental freedoms set forth by the European Convention for the Protection of Human Rights and Fundamental Freedoms.
Regularly signed and implemented international agreements on the protection of human rights and freedoms shall prevail over domestic legislation in case of conflict. (Art. 1) - ItalianLa Repubblica di San Marino riconosce, come parte integrante del proprio ordinamento, le norme di diritto internazionale generalmente riconosciute e conforma ad esse i suoi atti e la condotta. Riconferma il diritto di asilo politico. Rifiuta la guerra come strumento di risoluzione delle controversie fra Stati e si conforma, nell'azione internazionale, ai principi sanciti dallo Statuto delle Nazioni Unite.
L'ordinamento sammarinese riconosce, garantisce ed attua i diritti e le libertà fondamentali enunciate nella Convenzione Europea per la salvaguardia dei diritti dell'uomo e delle libertà fondamentali.
Gli accordi internazionali in tema di protezione delle libertà e dei diritti dell'uomo, regolarmente stipulati e resi esecutivi, prevalgono in caso di contrasto sulle norme interne. (Art. 1)

- EnglishAll persons, authorities and institutions are subject to the Constitution.
The judges, administrative authorities, and public servants shall directly apply constitutional standards and those provided for in international human rights instruments, as long as the latter are more favorable than those set forth in the Constitution, although the parties do not invoke them expressly.
The rights enshrined in the Constitution and international human rights instruments shall be for immediate observance and enforcement. The absence of a law or lack of knowledge about the norms cannot be alleged to justify the violation of rights and guarantees enshrined in the Constitution, to dismiss proceedings for their defense, or to refuse recognition of these rights. Las juezas y jueces, autoridades administrativas y servidoras y servidores públicos, aplicarán directamente las normas constitucionales y las previstas en los instrumentos internacionales de derechos humanos siempre que sean más favorables a las establecidas en la Constitución, aunque las partes no las invoquen expresamente.
Los derechos consagrados en la Constitución y los instrumentos internacionales de derechos humanos serán de inmediato cumplimiento y aplicación. No podrá alegarse falta de ley o desconocimiento de las normas para justificar la vulneración de los derechos y garantías establecidos en la Constitución, para desechar la acción interpuesta en su defensa, ni para negar el reconocimiento de tales derechos. (1) Judges, in the performance of their function, shall be independent and, in decision making shall be bound by the Constitution, by constitutional law, by international treaty pursuant to Art. 7, paras. 2 and 5, and by law.
(2) If a Court assumes that other generally binding legal regulation, its part, or its individual provisions which concern a pending matter contradicts the Constitution, constitutional law, international treaty pursuant to Art. 7, para. 5 or law, it shall suspend the proceedings and shall submit a proposal for the commence of proceedings according to Art. 125, para. 1. Legal opinion of the Constitutional Court of the Slovak Republic contained in the decision shall be binding for the Court. (Art. 144) - Slovak
(1) Sudcovia sú pri výkone svojej funkcie nezávislí a pri rozhodovaní sú viazaní ústavou, ústavným zákonom, medzinárodnou zmluvou podľa čl. 7 ods. 2 a 5 a zákonom.

- EnglishThe State has the duty to assure the diffusion and the teaching of the Constitution, of the Universal Declaration of the Rights of Man of 1948, of the African Charter of the Rights of Man and of Peoples of 1981 as well as of all international instruments duly ratified relative to Human Rights.
The State must integrate the rights of the human person in the programs of literacy [alphabétisation] and of teaching in the different schooling and university cycles and in all the programs of training of the armed forces, the forces of public security and similar forces.
The State must equally assure in the national languages by all means of mass communication, in particular by radio and television, the diffusion and the teaching of these same rights. L’Etat doit intégrer les droits de la personne humaine dans les programmes d’alphabétisation et d’enseignement aux différents cycles scolaires et universitaires et dans tous les programmes de formation des forces armées, des forces de sécurité publique et assimilés.
L’Etat doit également assurer dans les langues nationales par tous les moyens de communication de masse, en particulier par la radiodiffusion et la télévision, la diffusion et l’enseignement de ces mêmes droits. (Art. 25)
