(3) Where the High Court or the Court of Appeal is seised of an issue the resolution of which involves a question concerning the interpretation or application of the Treaty, the High Court or the Court of Appeal, as the case may be, shall, if it considers that a decision on the question is necessary to enable it to deliver judgment, refer the question to the Caribbean Court of Justice for determination before delivering judgment. (b) opinion of the Commission given in a report adopted under Article 31 of the Convention,

Si la Cour Suprême, saisie par le Président de l’Union, par le Président de l’Assemblée de l’Union ou par les Gouverneurs des Iles, déclare qu’un engagement international comporte une clause contraire à la Constitution, l’autorisation de la ratifier ou de l’approuver ne peut intervenir qu’après la révision de la Constitution.

- EnglishInternational treaties and agreements ratified by the Congress that recognize human rights and that prohibit their limitation in the states of emergency, have prevalence in the internal order. The rights and duties consecrated in this Charter will be interpreted in conformity with international treaties on human rights ratified by Colombia.
The Colombian State can recognize the jurisdiction of the International Criminal Court in the terms specified in the Statute of Rome adopted on 17 of July of 1998 by the Plenipotentiary Conference of the United Nations and, consequently, to ratify this treaty in accordance within the procedure established in this Constitution.
The admission of a substantial disparity in treatment by the Statute of Rome with respect to the guarantees contained in the Constitution will have effects exclusively within the scope of the matter regulated in it. - EnglishThe exercise of the rights ensuing from the European Union acquis communautaire shall be made equal to the exercise of rights under the Croatian legal order.
All the legal acts and decisions accepted by the Republic of Croatia in European Union institutions shall be applied in the Republic of Croatia in accordance with the European Union acquis communautaire.
Croatian courts shall protect individual rights based on the European Union acquis communautaire.
State bodies, bodies of local and regional self-government and legal persons vested with public authority shall apply European Union law directly. (3) For the purposes of determining whether or not any law, matter or thing is reasonably justified in a democratic society that has a proper regard for the rights and dignity of mankind, a court may have regard to-
(a) the provisions of this Constitution generally, and especially the National Goals and Directive Principles and the Basic Social Obligations; and
(b) the Charter of the United Nations; and
(c) the Universal Declaration of Human Rights and any other declaration, recommendation or decision of the General Assembly of the United Nations concerning human rights and fundamental freedoms; and
(d) the European Convention for the Protection of Human Rights and Fundamental Freedoms and the Protocols thereto, and any other international conventions, agreements or declarations concerning human rights and fundamental freedoms; and
(e) judgements, reports and opinions of the International Court of Justice, the European Commission of Human Rights, the European Court of Human Rights and other international courts and tribunals dealing with human rights and fundamental freedoms; and
(f) previous laws, practices and judicial decisions and opinions in the country; and
(g) laws, practices and judicial decisions and opinions in other countries; and
(h) the Final Report of the pre-Independence Constitutional Planning Committee dated 13 August 1974 and presented to the pre-Independence House of Assembly on 16 August 1974, as affected by decisions of that House on the report and by decisions of the Constituent Assembly on the draft of this Constitution; and
(i) declarations by the International Commission of Jurists and other similar organizations; and
(j) any other material that the court considers relevant. (Sec. 39)
