- EnglishAll persons, authorities and institutions are subject to the Constitution.
The judges, administrative authorities, and public servants shall directly apply constitutional standards and those provided for in international human rights instruments, as long as the latter are more favorable than those set forth in the Constitution, although the parties do not invoke them expressly.
The rights enshrined in the Constitution and international human rights instruments shall be for immediate observance and enforcement. The absence of a law or lack of knowledge about the norms cannot be alleged to justify the violation of rights and guarantees enshrined in the Constitution, to dismiss proceedings for their defense, or to refuse recognition of these rights. - English1. No derogation from rights contained in this Chapter10 shall be permissible save to the extent provided for by this section and no such derogation shall be made unless there has been a declaration of a state of emergency within the meaning of this section.

a. the right to life;

c. the prohibition of genocide;
d. the prohibition of slavery, the slave trade and slave-like practices;

f. the prohibition on retrospective criminalization and the retrospective imposition of greater penalties for criminal acts;
g. the right to equality and recognition before the law;
h. the right to freedom of conscience, belief, thought and religion and to academic freedom; or
i. the right to habeas corpus.

a. such derogation is consistent with the obligations of Malawi under international law;

Status of International Law
- English1. The norms and principles of general or common international law form an integral part of Portuguese law.
2. The norms contained in duly ratified or approved international conventions come into force in Portuguese internal law once they have been officially published, and remain so for as long as they are internationally binding on the Portuguese state.
3. The norms issued by the competent organs of international organisations to which Portugal belongs come directly into force in Portuguese internal law, on condition that this is laid down in the respective constituent treaties.
4. The provisions of the treaties that govern the European Union and the norms issued by its institutions in the exercise of their respective competences are applicable in Portuguese internal law in accordance with Union law and with respect for the fundamental principles of a democratic state based on the rule of law.
