- EnglishThe Constitutional Court is charged with the control of the constitutionality of the laws and of the acts having the force of law.
The organic laws, before their promulgation, and the Internal Regulations of the parliamentary Chambers and of the Congress, of the Independent National Electoral Commission as well as of the Superior Council for Audiovisual and Communication, before their entry into application, must be submitted to the Constitutional Court which rules on their conformity with the Constitution.
For the same end of examining [the] constitutionality, the laws may be referred to the Constitutional Court, before their promulgation, by the President of the Republic, the Prime Minister, the President of the National Assembly, the President of the Senate or a tenth of the Deputies or of the Senators.

- English1. In addition to the right of appeal accorded by section 47 of this Constitution, an appeal shall lie as of right to the Court of Appeal from decisions of the High Court in the following cases, that is to say:
a. subject to section 69 of this Constitution, final decisions in any civil or criminal proceedings on questions as to the interpretation of this Constitution, including any such decision made on a reference to the High Court under section 128;
b. final decisions of the High Court in the determination of any question in respect of which a right of access to the High Court is guaranteed by section 17 of this Constitution and final decisions of the High Court under section 22 of this Constitution.

The laws prior to the Constitution must be modified, if it applies, to render them in conformity with the constitutional rights and freedoms within a time period not exceeding three years counting from the date of promulgation of this Constitutional Law.

Les lois antérieures à la Constitution doivent être modifiées, s’il y a lieu, pour les rendre conformes aux droits et libertés constitutionnels, dans un délai n’excédant pas trois (3) ans pour compter de la date de promulgation de la présente loi constitutionnelle.

- English1. At the request of the President of the Republic or, on the grounds of infringement of the laws of the Autonomous Region of Príncipe, of the Chairman of the Regional Legislative, the Constitutional Court shall review and verify non-compliance with the Constitution by omission of the legislative measures necessary for making the constitutional rules enforceable.
2. Whenever the Constitutional Court verifies the existence of unconstitutionality by omission, it shall notify the appropriate legislative body. (Art. 148) - Portuguese1. Any citizen can refer [a matter] to the Constitutional Court on the constitutionality of the laws, either directly, or by the procedure of the pleadings [exception] of unconstitutionality invoked in a matter which concerns that citizen before a jurisdiction.
