- EnglishCitizens individually or collectively shall be entitled to file a special petition for protection against judgments, final writs or resolutions that have the force of sentencing. For ruling on the admissibility of this appeal, the court shall check compliance with the following requirements:
1. That the judgments, writs and resolutions are final and fully enforceable.
2. That the complainant shows that, in the judgment, there has been a breach, either by deed or omission, of due process of law or other rights enshrined in the Constitution. - English(1) An appeal to the Court of Appeal shall lie as of right from decisions of the High Court in the following cases, that is to say -
(a) final decisions in any civil or criminal proceedings on questions as to the interpretation of this Constitution; and
(b) final decisions given in exercise of the jurisdiction conferred on the High Court by article 153 (which relates to the enforcement of fundamental rights and freedoms).
(2) Nothing in paragraph (1) shall apply to the matters for which provision is made by article 163. (Art. 133)

The following recourses and mechanisms of constitutional control are also established:
1) The Recourse of Habeas Data as guarantee of protection [tutela] of personal data established [asentados] in archives, registers, databases or other technical means, of public or private nature, whose publicity constitutes [an] invasion of personal privacy and has relevance to the treatment of sensitive data of the persons in their intimate and familiar domain [ámbito]. The Recourse of Habeas Data proceeds in favor of any person to know in what circumstances, to what ends, when, and who makes contact with their personal data and its improper [indebida] publicity.
2) The conflict of competence and constitutionality between the Powers of the State. The representatives of the Powers of the State will promote the conflict of competence and constitutionality when they consider that a law, decree or regulation, act, resolution or provision of another organ [órgano], invades the domain of their privative constitutional competences.
3) The control of constitutionality in [a] concrete case as incidental mechanism of control. When in a case submitted to the cognizance of [a] judicial authority, it considers that a norm on whose validity the decision [fallo] depends is contrary to the Constitution, it must proceed to declare its unconstitutionality for that specific [en concreto] case. The parties in the process may solicit the unconstitutionality of a norm that is being applied to the case. The judicial authority must pronounce itself on the point, accepting [acogiendo] or rejecting the claim [pretensión].
4) The conflicts of constitutionality between the Central Government and the Municipal Governments and [Governments] of the Autonomous Regions of the Caribbean Coast.

Se establecen también los siguientes recursos y mecanismos de control constitucional:
1) El Recurso de Habeas Data como garantía de tutela de datos personales asentados en archivos, registros, bancos de datos u otros medios técnicos, de naturaleza pública o privada, cuya publicidad constituya invasión a la privacidad personal y tenga relevancia con el tratamiento de datos sensibles de las personas en su ámbito íntimo y familiar. El Recurso de Habeas Data procede a favor de toda persona para saber quién, cuándo, con qué fines y en qué circunstancias toma contacto con sus datos personales y su publicidad indebida.
2) El conflicto de competencia y constitucionalidad entre los Poderes del Estado. Los representantes de los Poderes del Estado promoverán el conflicto de competencia y constitucionalidad cuando consideren que una ley, decreto o reglamento, acto, resolución o disposición de otro órgano, invade el ámbito de sus competencias privativas constitucionales.
3) El control de constitucionalidad en caso concreto como un mecanismo incidental de control. Cuando en un caso sometido al conocimiento de autoridad judicial, ésta considere que una norma de cuya validez depende el fallo es contraria a la Constitución, deberá proceder a declarar su inconstitucionalidad para el caso en concreto. Las partes en el proceso pueden solicitar la inconstitucionalidad de una norma que se esté aplicando al caso. La autoridad judicial deberá pronunciarse sobre el punto, acogiendo o rechazando la pretensión.
4) Los conflictos de constitucionalidad entre el Gobierno Central y los Gobiernos Municipales y de las Regiones Autónomas de la Costa Caribe.
La Ley de Justicia Constitucional regulará los recursos y mecanismos establecidos en este capítulo. (Art. 190)

- EnglishSubject to the provisions of section 39(8), an appeal shall lie from decisions of the High Court to the Court of Appeal as of right in the following cases—
(a) final decisions in any civil or criminal proceedings on questions as to the interpretation of this Constitution;

- EnglishThe following are functions of the Constitutional Division of the Supreme Tribunal of Justice:
1. To declare the nullity, in whole or in part, of national laws and other acts of National Assembly with the force of law, which are in conflict with this Constitution.
2. To declare the nullity, in whole or in part, of state Constitutions and laws, municipal ordinances and other acts of the deliberating bodies of the States and Municipalities which are issued by way of direct and immediate implementation of the Constitution and are in conflict with the same.
3. To declare the nullity, in whole or in part, of acts of the National Executive with the force of law, which are in conflict with this Constitution.
4. To declare the nullity, in whole or in part, of acts issued by way of direct and immediate implementation of the Constitution by any other government organ exercising Public Power.
5. To verify, at the request of the President of the Republic or the National Assembly, the constitutionality of international treaties signed by the Republic, prior to ratification of the same.
6. To review in all cases, even ex officio, the constitutionality of decree of the President of the Republic decreeing states of exception.
7. To declare the unconstitutionality of omissions on the part of the municipal, state, national or legislatures, in failing to promulgate rules or measures essential to guaranteeing compliance with the Constitution, or promulgating it in an incomplete manner; and to establish the time limit and, where necessary, guidelines for correcting the deficiencies.
8. To resolve any conflicts existing between different provisions of law, and declare which of the same must prevail.
9. To resolve constitutional controversies arising between any of the organs of Public Power.
10. To review judgments embodying constitutional protective orders or control on the constitutionality of laws or juridical rules, handed down by the courts of the Republic, on the terms established by the pertinent organic law.
11. Any other functions established by this Constitution or by law. (Art. 336) - SpanishSon atribuciones de la Sala Constitucional del Tribunal Supremo de Justicia:
1. Declarar la nulidad total o parcial de las leyes nacionales y demás actos con rango de ley de los cuerpos legislativos nacionales que colidan con esta Constitución.

5. Verificar, a solicitud del Presidente o Presidenta de la República o de la Asamblea Nacional, la conformidad de la Constitución con los tratados internacionales suscritos por la República antes de su ratificación.
6. Revisar, en todo caso, aun de oficio, la constitucionalidad de los decretos que declaren estados de excepción dictados por el Presidente o Presidenta de la República.
7. Declarar la inconstitucionalidad de las omisiones del legislador o la legisladora nacional, estadal o municipal, cuando haya dejado de dictar las normas o medidas indispensables para garantizar el cumplimiento de la Constitución, o las haya dictado en forma incompleta, y establecer el plazo y, de ser necesario, los lineamientos de su corrección.
8. Resolver las colisiones que existan entre diversas disposiciones legales y declarar cuál de éstas debe prevalecer.
9. Dirimir las controversias constitucionales que se susciten entre cualesquiera de los órganos del Poder Público.
10. Revisar las sentencias de amparo constitucional y de control de constitucionalidad de leyes o normas jurídicas dictadas por los Tribunales de la República, en los términos establecidos por la ley orgánica.
11. Las demás que establezcan esta Constitución y la ley. (Art. 336)

- EnglishThe Popular Action (la Accion Popular) shall proceed against any act or omission by the authorities or individuals or collectives that violates or threatens to violate rights and collective interests related to public patrimony, space, security and health, the environment and other rights of a similar nature that are recognized by this Constitution. - English(1) Subject to the provisions of section 40(7) of this Constitution, an appeal shall lie from decisions of the High Court to the Court of Appeal as of right in the following cases:
(a) final decisions in any civil or criminal proceedings on questions as to the interpretation of this Constitution;
(b) final decisions given in exercise of the jurisdiction conferred on the High Court by section 16 of this Constitution (which relates to the enforcement of the fundamental rights and freedoms).
(2) An Appeal shall lie from final decisions of the Public Service Board of Appeal to the Court of Appeal.
(3) The Chief Justice may make rules with respect to the practice and procedure of the Court of Appeal in relation to appeals from the Public Service Board of Appeal to the Court of Appeal. (Sec. 105)

(Art. 183)

- EnglishThe declaration of unconstitutionality of a law and its abrogation [derogación], may be solicited, by anyone who considers himself injured in his direct, personal, and legitimate interest:
1) By way of action that must be brought [entablar] before the Supreme Court of Justice;
2) By way of exception. which may be opposed in any judicial proceeding; and
3) Also[,] the Jurisdictional Organ that takes cognizance in any Judicial proceeding may solicit[,] of office[,] the declaration of unconstitutionality of a Law and its abrogation before dictating a decision [resolución].
In the cases contemplated in numerals 2) and 3), the activity [actuaciones] must be elevated to the Supreme Court of Justice[,] the procedure following from the moment of summons for decision [sentencia], after which the judicial procedure of the partial question in the sphere of the resolution concerning the unconstitutionality must be suspended. En los casos contemplados en los numerales 2) y 3), se debe elevar las actuaciones a la Corte Suprema de Justicia, siguiéndose el procedimiento hasta el momento de la citación para la sentencia, a partir de lo cual se debe suspender el procedimiento judicial de la cuestión parcial en espera de la resolución sobre la inconstitucionalidad. - English[The following] are duties and attributions of the Constitutional Chamber:
1. to take cognizance [conocer] and to decide [resolver] on the unconstitutionality of the laws and of other normative instruments, declaring the inapplicability of the provisions contrary to this Constitution in each concrete case and in decision [fallo] that will only be effective in relation with that case, and
2. to decide on the unconstitutionality of the definitive or interlocutory sentences, declaring the nullity of those that result [as being] contrary to this Constitution.
The proceeding may be initiated by [an] action before the Constitutional Chamber of the Supreme Court of Justice, and by way [vía] of an excepción [pleadings of exception] in any instance, in which case the prior records [antecedentes] will rise [se elevarán] to the Court.
