- EnglishAfter a law has been promulgated, the King, the President of the Senate, the President of the National Assembly, the Prime Minister, one-fourth of the Senators, one-tenth of the National Assembly’s Members, or the Courts can request the Constitutional Council to examine the constitutionality of that law.
Any citizen has the right to raise the unconstitutionality of the laws through the intermediary of the National Assembly’s Members or that of the President of the National Assembly or of the Senators or of the President of the Senate, as provided in the aforementioned paragraph. - English1. The Public Prosecutor’s Office and persons who, in conformity with the law regulating the constitutionality review process, have legitimacy to file an appeal, shall have the right to appeal with the Constitutional Court.
2. The appeal referred to in the preceding paragraph may only be filed after resort to other appeals provided for in the law of the proceedings in which the judgment was handed down have been exhausted, and the appeal shall be limited to the question of unconstitutionality or illegality, as the case may be.
3. The appeal filed against the decisions referred to in subparagraph c) of paragraph 1 and in the first part of subparagraph a) of paragraph 2 of the preceding article shall be mandatorily filed with the Public Prosecutor’s Office. - EnglishI. The Popular Action shall be filed during the period in which the violation or threat to the rights and collective interests continues. To file this action it is not necessary to exhaust the judicial or administrative processes that might exist.
II. Any person, in his or her individual name or on behalf of a collective, may file this action, and it shall be filed obligatorily by the Public Ministry and the Public Defender (Ministerio Público y el Defensor del Pueblo) when, in the exercise of their functions, they have knowledge of these acts. The procedure for the Action for Constitutional Protection shall be applied. (Art. 136) - SpanishI. La Acción Popular podrá interponerse durante el tiempo que subsista la vulneración o la amenaza a los derechos e intereses colectivos. Para interponer esta acción no será necesario agotar la vía judicial o administrativa que pueda existir.
II. - EnglishThe Constitutional Court is the judge of the exceptions of unconstitutionality raised before or by a jurisdiction.
Any person may refer the Constitution Court to [a matter concerning] the unconstitutionality of any legislative or regulatory act.
In addition, he may refer the Constitutional Court to [a matter], by the procedure of the exception of unconstitutionality invoked in a matter concerning him before a jurisdiction.
That [jurisdiction] stays [its] decision and refers the Constitutional Court to [it], all [other] matters ceasing. (Art. 162) - FrenchLa Cour constitutionnelle est juge de l’exception d’inconstitutionnalité soulevée devant ou par une juridiction.

- English1. The following entities - for limitation - shall the right to directly challenge at the Constitutional Court the constitutionality of the applicable laws and regulations:
a. The Senate.
b. The House of Representatives.
c. The Council of Ministers.
2. In the case viewed by courts, any of the parties of the case may raise the issue of the non-constitutionality; the court shall - if it finds that the plea is serious - refer it to the court specified by the law for the purposes of the determination of its referral to the Constitutional Court.
