- EnglishThe procedure and conditions for the appointment of justices of the Constitutional Court of the Republic of Croatia and the termination of their office, the conditions and time limits for instituting proceedings for the assessment of constitutionality and legality, the procedure and legal effects of its decisions, the protection of human rights and fundamental freedoms guaranteed by the Constitution, and other issues vital to the performance of the duties and work of the Constitutional Court of the Republic of Croatia shall be regulated by a constitutional act.
Such constitutional act shall be adopted in accordance with the procedure determined for amending the Constitution.

The Constitutional Council is referred to [a matter] by:
• the President of Faso;
• the Prime Minister;
• the President of the National Assembly;
• one-tenth (1/10) at least of the members of the National Assembly.
In addition, any citizen may refer [a matter] to the Constitutional Council concerning the constitutionality of the laws, either directly, or through the procedure of the pleadings [exception] of unconstitutionality invoked in a matter [affaire] which concerns them before a jurisdiction. This must postpone [the matter] until the decision of the Constitutional Council which must intervene within a maximum period of time of thirty days counting from its referral [to the matter].
The Constitutional Council can refer itself to any questions relative to its competence, if it judges it necessary. (Art. 157) - French
Le Conseil constitutionnel est saisi par :
• le Président du Faso;
• le Premier ministre;
• le Président de l'Assemblée nationale;
• un dixième (1/10) au moins des membres de chaque chambre du Parlement.
En outre, tout citoyen peut saisir le Conseil constitutionnel sur la constitutionnalité des lois, soit directement, soit par la procédure de l’exception d’inconstitutionnalité invoquée dans une affaire qui le concerne devant une juridiction. Celle-ci doit surseoir jusqu’à la décision du Conseil constitutionnel qui doit intervenir dans un délai maximum de trente jours à compter de sa saisine.
Le Conseil constitutionnel peut se saisir de toutes questions relevant de sa compétence s’il le juge nécessaire. (Art. 157)

- English(1) If a court concludes that a law on whose validity its decision depends is unconstitutional, the proceedings shall be stayed, and a decision shall be obtained from the Land court with jurisdiction over constitutional disputes where the constitution of a Land is held to be violated, or from the Federal Constitutional Court where this Basic Law is held to be violated. This provision shall also apply where the Basic Law is held to be violated by Land law and where a Land law is held to be incompatible with a federal law.
(2) If, in the course of litigation, doubt exists whether a rule of international law is an integral part of federal law and whether it directly creates rights and duties for the individual (Article 25), the court shall obtain a decision from the Federal Constitutional Court.
(3) If the constitutional court of a Land, in interpreting this Basic Law, proposes to deviate from a decision of the Federal Constitutional Court or of the constitutional court of another Land, it shall obtain a decision from the Federal Constitutional Court. (2) Ist in einem Rechtsstreite zweifelhaft, ob eine Regel des Völkerrechtes Bestandteil des Bundesrechtes ist und ob sie unmittelbar Rechte und Pflichten für den Einzelnen erzeugt (Artikel 25), so hat das Gericht die Entscheidung des Bundesverfassungsgerichtes einzuholen.
(3) Will das Verfassungsgericht eines Landes bei der Auslegung des Grundgesetzes von einer Entscheidung des Bundesverfassungsgerichtes oder des Verfassungsgerichtes eines anderen Landes abweichen, so hat das Verfassungsgericht die Entscheidung des Bundesverfassungsgerichtes einzuholen. (Art. 100)

– to judge the constitutionality of the organic and ordinary laws, already promulgated or simply voted, of the regulations as well as of the Internal Regulations of the National Assembly and of the Senate;

- EnglishThe Supreme Court and the lower courts of the Nation are empowered to hear and decide all cases arising under the Constitution and the laws of the Nation, with the exception made in Section 75, subsection 12, and under the treaties made with foreign nations; all cases concerning ambassadors, public ministers and foreign consuls; cases related to admiralty and maritime jurisdiction; matters in which the Nation shall be a party; actions arising between two or more provinces, between one province and the inhabitants of another province, between the inhabitants of different provinces, and between one province or the inhabitants thereof against a foreign state or citizen. - EnglishThe safeguarding of the integrity and supremacy of the Constitution is entrusted to the Constitutional Court in the strict and precise terms of this article. For such a purpose, it shall fulfill the following functions:
1. Decide on the petitions of unconstitutionality brought by citizens against measures amending the Constitution, no matter what their origin, exclusively for errors of procedure in their formation.
2. Decide, prior to a popular expression of opinion, on the constitutionality of the call for a referendum or a constituent assembly to amend the Constitution, exclusively for errors of procedure in their formation.
3. Decide on the constitutionality of referendums about laws and popular consultations and plebiscites of a national scope, in case of these last ones exclusively for errors of procedure in their convocation and implementation.
4. Decide on the petitions of unconstitutionality brought by citizens against statutes, both for their substantive content as well as for errors of procedure in their formation.
5. Decide on the petitions of unconstitutionality brought by citizens against decrees with the force of law issued by the government on the basis of Article 150, numeral 10, and Article 341 of the Constitution for their substantive content as well as for errors of procedure in their formation.
6. Decide on the exceptions provided for in Article 137 of the Constitution.
7. Decide definitively on the constitutionality of the legislative decrees issued by the government on the basis of Articles 212, 213, and 215 of the Constitution.
8. Decide definitively on the constitutionality of the bills opposed by the government as unconstitutional and of proposed statutory bills, both on account of their substantive content as well as for errors of procedure in their formation.
9. Revise, in the form determined by statute, the judicial decisions connected with the protection of constitutional rights.
10. To decide definitively on the constitutionality [exquibilidad/executability] of the international treaties and on the laws that approve them. To this end, the Government will submit them to the Court, within the six days subsequent to the sanction of the law. Any citizen can intervene to defend or challenge their constitutionality [constitucionalidad]. If the Court declares them constitutional, the Government may effect the exchange of notes; in the contrary case they will not be ratified. When one or several norms of a multilateral treaty are declared unconstitutional [inexquibilidad/unexecutable] by the Constitutional Court, the President of the Republic may only declare consent formulated [with] the corresponding reservation.
11. To settle [Dirimir] the conflicts of competence that occur between the distinct jurisdictions.

6. Decidir sobre las excusas de que trata el artículo 137 de la Constitución.
7. Decidir definitivamente sobre la constitucionalidad de los decretos legislativos que dicte el Gobierno con fundamento en los artículos 212, 213 y 215 de la Constitución.
8. Decidir definitivamente sobre la constitucionalidad de los proyectos de ley que hayan sido objetados por el Gobierno como inconstitucionales, y de los proyectos de leyes estatutarias, tanto por su contenido material como por vicios de procedimiento en su formación.
9. Revisar, en la forma que determine la ley, las decisiones judiciales relacionadas con la acción de tutela de los derechos constitucionales.
10. Decidir definitivamente sobre la exequibilidad de los tratados internacionales y de las leyes que los aprueben. Con tal fin, el Gobierno los remitirá a la Corte, dentro de los seis días siguientes a la sanción de la ley. Cualquier ciudadano podrá intervenir para defender o impugnar su constitucionalidad. Si la Corte los declara constitucionales, el Gobierno podrá efectuar el canje de notas; en caso contrario no serán ratificados. Cuando una o varias normas de un tratado multilateral sean declaradas inexequibles por la Corte Constitucional, el Presidente de la República sólo podrá manifestar el consentimiento formulando la correspondiente reserva.

- English1. The following may make application to the Constitutional Tribunal regarding matters specified in Article 188:
1) the President of the Republic, the Marshal of the Sejm, the Marshal of the Senate, the Prime Minister, 50 Deputies, 30 Senators, the First President of the Supreme Court, the President of the Chief Administrative Court, the Public Prosecutor-General, the President of the Supreme Chamber of Control, the Commissioner for Citizens' Rights,
2) the National Council of the Judiciary, to the extent specified in Article 186, para. 2;
3) the constitutive organs of units of local self-government;
4) the national organs of trade unions as well as the national authorities of employers' organizations and occupational organizations;
5) churches and religious organizations;
6) the subjects referred to in Article 79 to the extent specified therein.

2.) Krajowa Rada Sądownictwa w zakresie, o którym mowa w art. 186 ust. 2,
3.) organy stanowiące jednostek samorządu terytorialnego,
4.) ogólnokrajowe organy związków zawodowych oraz ogólnokrajowe władze organizacji pracodawców i organizacji zawodowych,
5.) kościoły i inne związki wyznaniowe,
6.) podmioty określone w art. 79 w zakresie w nim wskazanym.
2. Podmioty, o których mowa w ust. 1 pkt 3-5, mogą wystąpić z takim wnioskiem, jeżeli akt normatywny dotyczy spraw objętych ich zakresem działania. (Art. 191)
