Provided that no appeal shall lie from a determination of the High Court under this section dismissing an application on the ground that it is frivolous or vexatious. (Sec. 106)

The organic laws and the ordinances concerning the domain arising from the organic law are submitted by the Prime Minister to the Constitutional Court before their promulgation or their publication.The other categories of law, the ordinances as well as the regulatory acts that supposedly infringe the fundamental rights of the human person and the public freedoms may be deferred to the Constitutional Court, either by the President of the Republic, or by the Prime Minister, or by the Presidents of the Chambers of Parliament or one-tenth (1/10) of the members of each Chamber, or by the Presidents of the Court of Cassation, of the Council of State and of the Court of Accounts, or by any citizen or any juridical person prejudiced by the law or the ordinance contested.

- EnglishAny person may seek amparo before the Constitutional Chamber of the Supreme Court of Justice for violation of the rights granted by this Constitution.
The habeas corpus may be sought before the Constitutional Chamber of the Supreme Court of Justice or before the Chambers of Second Instance that do not reside in the capital. The resolution of the Chamber that denies the freedom of the favored person [favorecido] may be the object of review [revisión], at the request of the interested party, by the Constitutional Chamber of the Supreme Court of Justice. - English1. The Public Prosecutor’s Office and persons who, in conformity with the law regulating the constitutionality review process, have legitimacy to file an appeal, shall have the right to appeal with the Constitutional Court.
2. The appeal referred to in the preceding paragraph may only be filed after resort to other appeals provided for in the law of the proceedings in which the judgment was handed down have been exhausted, and the appeal shall be limited to the question of unconstitutionality or illegality, as the case may be.
3. The appeal filed against the decisions referred to in subparagraph c) of paragraph 1 and in the first part of subparagraph a) of paragraph 2 of the preceding article shall be mandatorily filed with the Public Prosecutor’s Office. Whenever the executive returns a bill, it shall again be debated in the National Congress, and if it is ratified by a two-thirds vote, it shall again be sent to the executive branch, with this phrase: “Constitutionally ratified” and the executive branch shall publish it forthwith.

(1) The Constitutional Court decides, by means of [an] order [arret], on the conformity of laws with the Constitution.
(2) The Constitutional Court may be referred to [a matter], under title of preliminary opinion [titre prejudiciel], following the modalities to be determined by the law, by any jurisdiction to decide on the conformity of the laws, with the exception of the laws concerning approval of treaties, with the Constitution.
(3) The Constitutional Court will regulate the disputes of attribution according to the mode determined by the law.
(4) The attributions of the Constitutional Court may be extended by a law voted by a qualified majority gathering at least two-thirds of the votes of the members of the chamber of deputies, the vote by proxy not being admitted.
