- EnglishAfter a law has been promulgated, the King, the President of the Senate, the President of the National Assembly, the Prime Minister, one-fourth of the Senators, one-tenth of the National Assembly’s Members, or the Courts can request the Constitutional Council to examine the constitutionality of that law.
Any citizen has the right to raise the unconstitutionality of the laws through the intermediary of the National Assembly’s Members or that of the President of the National Assembly or of the Senators or of the President of the Senate, as provided in the aforementioned paragraph. - English1. Court decisions shall be subject to appeal to the Constitutional Court whenever:
a) The courts refuse, on the grounds of unconstitutionality, to apply any rule or resolution of a content that is material and normative or specific and concrete;
b) They apply rules or resolutions of a content that is material and normative or specific and concrete, whose unconstitutionality has been challenged in the proceedings;
c) They apply rules or resolutions of a content that is material and normative or specific and concrete, which have previously been considered unconstitutional by the Constitutional Court itself.
2. Decisions shall also be subject to appeal to the Constitutional Court whenever:
a) They apply resolutions of a content that is material and normative or specific and concrete, which have previously been considered illegal by the Constitutional Court or whose illegality has been challenged in the proceedings.
b) They refuse to apply, on the grounds of illegality, the resolutions referred to in the preceding subparagraph. (Art. 281) - Portuguese1. Cabe recurso para o Tribunal Constitucional, das decisões dos Tribunais que:
a) Recusem, com fundamento em inconstitucionalidade, a aplicação de qualquer norma ou resolução de conteúdo material normativo ou individual e concreto;

- English1. Subject to Article 28, the Constitutional Court has original and final jurisdiction to hear—
a. a matter relating to the interpretation of this Constitution;
b. a matter relating to a violation or contravention of this Constitution;

2. Subject to Article 28 (2), where a question relating to this Constitution arises in a court, the person presiding in that court shall refer the question to the Constitutional Court.
3. Subject to Article 28, a person who alleges that—

c. an act, omission, measure or decision by a person or an authority; contravenes this Constitution, may petition the Constitutional Court for redress.

1°) compliance of the National Council’s rules of procedure with constitutional and, if need be, legislative provisions under the conditions prescribed by article 61;

- EnglishI. The Popular Action shall be filed during the period in which the violation or threat to the rights and collective interests continues. To file this action it is not necessary to exhaust the judicial or administrative processes that might exist.
II. Any person, in his or her individual name or on behalf of a collective, may file this action, and it shall be filed obligatorily by the Public Ministry and the Public Defender (Ministerio Público y el Defensor del Pueblo) when, in the exercise of their functions, they have knowledge of these acts. The procedure for the Action for Constitutional Protection shall be applied. (Art. 136) - SpanishI. La Acción Popular podrá interponerse durante el tiempo que subsista la vulneración o la amenaza a los derechos e intereses colectivos. II. - EnglishThe Constitutional Court is the judge of the exceptions of unconstitutionality raised before or by a jurisdiction.
Any person may refer the Constitution Court to [a matter concerning] the unconstitutionality of any legislative or regulatory act.
In addition, he may refer the Constitutional Court to [a matter], by the procedure of the exception of unconstitutionality invoked in a matter concerning him before a jurisdiction.

- English1. When the constitutionality of a law is at issue in a trial, the court shall request a decision of the Constitutional Court, and shall judge according to the decision thereof.
2. The Supreme Court shall have the power to make a final review of the constitutionality or legality of administrative decrees, regulations or actions, when their constitutionality or legality is at issue in a trial.

1. An appeal shall lie as of right from decisions of the Court of Appeal to the Caribbean Court of Justice in the following cases
